公司董事勤勉义务和裁判标准适用研究

我国《公司法》对董事勤勉义务的规定略显粗糙，导致司法适用出现混乱情况。通过比较英美法上的“适中标准”、德国法上的“专家标准”、日本法上的“善良管理人标准”，以及分析司法实践中法官对于该问题的判决，英美法上的“适中标准”适合我国国情。此外，法院判决必须考虑如下因素：董事在公司中的地位，公司经营的行业或公司的规模；公司的经营状况等。

中国古典文学作品的珍贵的史料价值已为学者所认可.本文通过对中国古代的文学作品和审判案例作为研究对象,研究中国古代的司法文化的若干特点.并对判决自身的文学特征及其对法律原则的影响作了一些论述.     

判决“不准离婚”制度之反思

我国判决“不准离婚”制度是在三次婚姻立法中均没有明文规定的情况下,形成于长期的法律解释和司法实践中。本文主要围绕现行《婚姻法》第32条第2款关于离婚之规定分析指出,在当代中国,应从社会与国家的二元分离视角重新认识和反思婚姻的本质及其与国家之间的关系,明确立法、行政和司法在离婚中仅具有消极功能。基于此,才能正确阐释立法之真实涵义和精神,进而揭示出原有理解的错误性和法律解释、司法实践的违法性。必然地,建基其上的判决“不准离婚”制度也是非法的和错误的。     

判决的整体性:科学发展观的应用

司法审判是一项合理化的事业,而在这种合理化事业中往往体现了一种整体主义的思想进路,这种整体性进路是对法律机械主义和形式主义的克服,是在法条之外谋求司法合理性的重要方式。司法判决的整体性既体现在古代中国的判决书当中,也表达在美国司法审判当中,而当代中国在司法中贯彻科学发展观的理念也是一种整体主义的重要体现,是进一步谋求司法合理化的手段,并有助于提升判决书的质量。     

基于深度学习的司法判决预测算法研究

司法判决预测任务指的是根据真实的案情描述文本来预测案件的判决结果,有助于司法专业人士高效的工作,在智能司法方面具有广阔的应用前景。在实践中,易混淆罪名和少样本罪名的判别问题是目前的两大难点,普通模型很容易在上述问题上出现误判。为使易混淆罪名得到更好的区分,结合BERT（Bidirectional Encoder Representations from Transformer）和双向门控循环单元（Bidirectional Gated Recurrent Unit, BiGRU)深度学习网络,提出BGAAT（BERT BiGRU Attribute Self-Attention）网络模型。该模型引入具有区分性的罪名属性标签,通过注意力机制分别抽取属性特征与上下文特征,使用注意力分布对可解释性进行描述。为使少样本罪名更好的被识别,引入罪名分类权重,使模型在少样本罪名分类取得了更高的F1值。最后在真实的司法判决数据集上进行了实验,证明了所提出模型在该任务上有良好表现。     

网络舆论干预司法公正的现象和危害

在司法实践中,由于判决不公、报道不当等原因,出现了网络舆论干预司法判决的现象,甚至＂媒体审判＂,具体案例有云南李昌奎案及赛锐27刀捅死女孩案、药家鑫案及药父诉张显侵犯名誉权案、彭宇案翻案及小悦悦案等。这对我国法制社会建设进程是很不利的,会产生超越监督界限、增大法官压力,引起舆论争议、浪费优质资源,损害司法权威、降低司法公信力等危害。网络干预的始作俑者是司法不够公正,并且网络的力量确实帮助部分受害者获得了公平,但这并不能说明网络干预就是完全正义的。司法判决的唯一依据是且只能是法律和事实,要减少网络舆论对司法判决的干预必须从源头做起,需要每个司法工作者都做到严格执法、秉公执法。

Markedness and its Interpretation in Language Use

Language markedness is a common phenomenon in languages, and is reflected from hearing, vision and sense, i.e. the variation in the three aspects such as phonology, morphology and semantics. This paper focuses on the interpretation of markedness in language use following the three perspectives, i.e. pragmatic interpretation, psychological interpretation and cognitive interpretation, with an aim to define the function of markedness.     

Features of Women's language

Language is a means of verbal communication. People use language to communicate with each other. In the society, no two speakers are exactly alike in the way of speaking. Some differences are due to age, gender, statue and personality. Above all, gender is one of the obvious reasons. Lower Paleozoic oil relationships within Williston Basin, Canada

The Williston Basin is a significant petroleum province, containing oil production zones that include the Middle Cambrian to Lower Ordovician, Upper Ordovician, Middle Devonian, Upper Devonian and Mississippian and within the Jurassic and Cretaceous. The oils of the Williston Basin exhibit a wide range of geochemical characteristics defined as "oil families", although the geochemical signature of the Cambrian Deadwood Formation and Lower Ordovician Winnipeg reservoired oils does not match any "oil family". Despite their close stratigraphic proximity, it is evident that the oils of the Lower Palaeozoic within the Williston Basin are distinct. This suggests the presence of a new "oil family" within the Williston Basin. Diagnostic geochemical signatures occur in the gasoline range chromatograms, within saturate fraction gas chromatograms and biomarker fingerprints. However, some of the established criteria and cross-plots that are currently used to segregate oils into distinct genetic families within the basin do not always meet with success, particularly when applied to the Lower Palaeozoic oils of the Deadwood and Winnipeg Formation.     

低渗透非均质砂岩油藏启动压力梯度研究

理论推导与室内实验相结合,建立了低渗透非均质砂岩油藏启动压力梯度确定方法。首先借助油藏流场与电场相似的原理,推导了非均质砂岩油藏启动压力梯度计算公式。其次基于稳定流实验方法,建立了非均质砂岩油藏启动压力梯度测试方法。结果表明:低渗透非均质砂岩油藏的启动压力梯度确定遵循两个等效原则。平面非均质油藏的启动压力梯度等于各级渗透率段的启动压力梯度关于长度的加权平均;纵向非均质油藏的启动压力梯度等于各渗透率层的启动压力梯度关于渗透率与渗流面积乘积的加权平均。研究成果可用于有效指导低渗透非均质砂岩油藏的合理井距确定,促进该类油藏的高效开发。

橡胶颗粒沥青混合料低温抗裂性试验研究

以AC-13级配为基础,将橡胶颗粒代替部分集料掺入混合料中,以低温弯曲试验为评价方法对不同橡胶颗粒掺量下沥青混合料的低温抗裂性进行研究,并引入应变能密度值对混合料的低温抗裂性进行综合评价.试验结果表明:橡胶颗粒沥青混合料试件的破坏微应变均超过2 300,满足冬寒区的技术指标;无论是否掺加橡胶颗粒,随着温度的下降,沥青混合料破坏时的最大弯拉强度增大,弯拉应变降低,劲度模量增大;弯曲应变能密度在胶粒掺量为1%左右时具有较大的弯曲应变能密度值,此时橡胶颗粒沥青混合料具有较好的低温抗裂性.
