动产抵押制度的再思考——以动产抵押的适用范围与登记制度为中心

动产抵押制度虽然已经在我国法律中予以确立,然而其制度本身却与我国物权法体系不相协调,违背我国物权法传统的公示公信原则,实践中,由于动产抵押适用范围限制较少、登记制度不完善等原因,导致动产抵押制度不能有效适用于经济社会发展中的诸多问题。通过对一般动产抵押制度合理性质疑,结合动产抵押的适用范围与登记两方面,提出完善措施。

论“其他财产”抵押权的物上追及力与对抗第三人的例外

我国对于动产抵押采取登记对抗主义的方法,动产抵押权自抵押合同生效时设立。根据《物权法》第一百八十第一款条第(七)项,"法律、行政法规未禁止抵押的其他财产"属于可抵押财产之范围,具体应包括其他动产、部分限制流通物以及某些财产性权利等。就此类财产的抵押是否应当登记,登记的效力如何以及抵押权对抗第三人的范围的程度,现行法律并没有明文规定。因此,从立法者本意的角度出发进行具体情况具体分析,努力澄清该模糊之处,对于动产抵押登记制度的理论研究和司法实践都甚有裨益。     

谈未办理抵押登记合同是否生效的问题

抵押登记的效力,从世界各国来看,存在着三种不同的立法例.关于未登记抵押权究竟有何效力,理论上主要有五种学说.我国司法实践中,当事人签订抵押合同未登记,一概认定抵押合同无效,笔者认为,抵押权登记行为只能是抵押合同生效以后的履行行为,而非抵押合同的生效要件,抵押物的登记应采取登记对抗主义.

This paper focuses on the interpretation of markedness in language use following the three perspectives, i.e. pragmatic interpretation, psychological interpretation and cognitive interpretation, with an aim to define the function of markedness.

Language is a means of verbal communication. People use language to communicate with each other. In the society, no two speakers are exactly alike in the way of speaking. Some differences are due to age, gender, statue and personality. Above all, gender is one of the obvious reasons. The writer of this paper tries to describe the features of women＇s language from these perspectives： pronunciation, intonation, diction, subjects, grammar and discourse. From the discussion of the features of women＇s language, more attention should be paid to language use in social context. Lower Paleozoic oil relationships within Williston Basin, Canada

The Williston Basin is a significant petroleum province, containing oil production zones that include the Middle Cambrian to Lower Ordovician, Upper Ordovician, Middle Devonian, Upper Devonian and Mississippian and within the Jurassic and Cretaceous. The oils of the Williston Basin exhibit a wide range of geochemical characteristics defined as "oil families", although the geochemical signature of the Cambrian Deadwood Formation and Lower Ordovician Winnipeg reservoired oils does not match any "oil family". Despite their close stratigraphic proximity, it is evident that the oils of the Lower Palaeozoic within the Williston Basin are distinct. This suggests the presence of a new "oil family" within the Williston Basin. Diagnostic geochemical signatures occur in the gasoline range chromatograms, within saturate fraction gas chromatograms and biomarker fingerprints. However, some of the established criteria and cross-plots that are currently used to segregate oils into distinct genetic families within the basin do not always meet with success, particularly when applied to the Lower Palaeozoic oils of the Deadwood and Winnipeg Formation.     

低渗透非均质砂岩油藏启动压力梯度研究

理论推导与室内实验相结合,建立了低渗透非均质砂岩油藏启动压力梯度确定方法。首先借助油藏流场与电场相似的原理,推导了非均质砂岩油藏启动压力梯度计算公式。其次基于稳定流实验方法,建立了非均质砂岩油藏启动压力梯度测试方法。结果表明:低渗透非均质砂岩油藏的启动压力梯度确定遵循两个等效原则。平面非均质油藏的启动压力梯度等于各级渗透率段的启动压力梯度关于长度的加权平均;纵向非均质油藏的启动压力梯度等于各渗透率层的启动压力梯度关于渗透率与渗流面积乘积的加权平均。研究成果可用于有效指导低渗透非均质砂岩油藏的合理井距确定,促进该类油藏的高效开发。
