农村土地承包经营权物权性流转

农村土地承包经营权物权流转，即农地承包权的转让、互换、抵押、出典与入股。通过这几种流转，可以实现农用土地的有效利用，使农民致富的机会增多。     

产权价值视阈下区域农地承包经营权流转价值实证分析——以潍坊市为例

农地承包经营权从农户产权角度可分为承包权和经营权,不同的流转方式会产生不同的价值内涵。在此以潍坊市为例,对农地承包经营权转包和转让的流转价格进行了测算。经过估算,以小麦、玉米净收益作为单位面积农地生产纯收益得出的10年期潍坊市农地经营权转包价格为8720.68元/hm~2,与区域实地调研结果基本吻合;30年期农地承包权与经营权转让价格为305342.03元/hm~2,与征地最高补偿价值基本吻合。     

我国城镇化进程中债权化对现代农地产权变革的优越性

在我国城镇化进程中,农村土地资源的流转和利用受到了现行农地产权制度的种种阻碍。债权具有着先天性促进融资和流通的功能。本文从农地产权的历史变迁以及法学、经济学等多角度详细论证了债权化对农地产权尤其是土地承包权的必要性和优越性,提出如何使有限的土地资源更好发挥其在现代市场机制中的优化配置作用,进而实现现代化农业发展的模式。     

中国农地金融制度体系的基础制度构建

根据我国目前农地金融制度体系存在的有关制度缺陷，提出了建立农地金融制度的基础制度：(1)改革农地经营方式，明确农村土地所有权，稳定土地承包权，促进农地使用权合理流转，健全土地产权法规；（2）采用避免风险、控制损失与转嫁风险等措施，防范农地金融风险；(3)建立科学的农地评估体系，提高评估从业人员素质，正确处理政府、评估师协会、评估机构和评估师的关系，促进评估机构开展公平竞争，允许国外土地评估机构进入中国评估市场。     

川东丘陵山区农地流转问题研究：以四川达州为视角

＂农地流转＂被学者称为中国继＂土地改革＂、＂家庭联产承包责任制＂之后中国农村土地的＂第三次革命＂。我国农地流转经历了自由流转、严格限制、重新恢复的发展历程。当前达州农地流转呈现出：流转形式多样化、流转势头增长化、流转区域差异化、流转格局多元化、流转规模小型化、流转方向随意化等特点。农地流转存在思想认识不足、流转行为不规范、流转市场化程度低、流转规模较小、流转监管不力等突出问题。建议通过推动农地流转科学研究,宣传普及农地流转相关知识,消除农地流转方面的思想认识障碍;推动区域经济发展,为农村剩余劳动力开辟更广阔的非农就业空间;加快农村社会保障制度建设,消除农民对农地流转的后顾之忧;健全农地流转机制,切实保障农地流转中农民的合法权益;培育农地流转中介服务组织,逐步提高农地流转的市场化水平等措施,引导其有序发展。     

再论农地制度创新与农地资源的可持续利用

近二十年来中国经历了三次大的社会转型，进入了最佳发展时期．但随着“三化”进程的深入，农业发展不稳定、农业生产要素结构性扭曲、农地利用及其制度缺陷等问题日显严峻．制度是促进经济发展的根本性变量，农地制度创新在农地可持续利用中起决定性作用．要解决“三农”问题必须解决其根源问题——现有农地制度与农地可持续利用的结构性矛盾．为此，要创新农地产权制度，确保产权主体在．配置农地资源上的核心作用；完善农地流转制度，提高农地规模经营水平；建立农地保障替代机制，强化农地的生态、生产功能．     

我国宅基地使用权流转的解禁

农村宅基地等农地使用权流转一直为我国现行法律所禁止。这一起源于计划经济时期的农村土地管理法律制度在现阶段市场经济条件下面临日益严峻的挑战。尽管学术界在我国农地使用权能否流转问题上争议很大,但随着这一法律制度得以支撑的经济基础的丧失、对经济建设阻碍作用的凸现以及法律的公平性遭到质疑,解禁宅基地等农地使用权流转已为大势所趋。我国应当因势利导在正确的立法理念指导下,完善宅基地等农地使用权流转的配套法律机制,在试点的基础上逐步开禁宅基地等农地使用权的流转,科学完善农地使用权流转制度。     

村干部身份对农地流转契约的影响及扩散效应研究：以流转期限为例

讨论农业转型背景下农地流转契约问题对促进农地长期性投资和解决农地质量下降等问题有重要意义。以农地流转期限为例,从农地流转行为嵌入正式制度和以村庄社会为承载主体的非正式制度出发,研究在村规民约的形成中扮演重要角色的村干部身份会如何影响农地流转期限。使用Logit模型、CMP估计方法等方法和第三轮中国家庭金融调查数据,实证检验村干部身份与农地流转期限的关系及影响机制。研究结果显示：第一,村干部身份促进农户农地长期转出。与没有村干部的家庭相比,有家庭成员担任村干部的农户选择农地长期转出的可能性显著提高。第二,村干部身份影响农地流转期限的路径有两条,主要是通过降低农地流转中的交易费用和违约风险促进农户农地长期转出。第三,村干部身份对农地流转期限的影响在不同关系文化区域存在异质性,村干部身份在高关系文化区域对农地长期转出的促进作用要高于低关系文化区域。第四,村干部的农地流转行为具有外溢性,当村干部家庭选择农地长期转出时,会带动周围自发流转的农户长期转出农地。需突出村干部及村民自治组织的代理人角色,充分发挥村干部“领头羊”的带头和示范作用。     

农地流转模式的经济效率分析——以山东枣庄为考察对象

按照农地流转主体与贡献力量的差异,将现有的农地流转模式划分为政府主导型的农地流转模式与农户主导型的农地流转模式,并就两种农地流转模式的产生原因进行分析。同时,基于山东省枣庄市的实地调研数据,从农地流转收益、流转成本、流转合同的稳定性以及农地流转的困难程度对两种流转模式进行量化分析,发现农户主导型的农地流转模式的流转效率。因此,为了推动农地流转市场的健康发展,要防止政府对农地流转的过度干预。     

WTO背景下的中国农地流转制度创新方向

WTO相关原则及中国政府的承诺对农地流转制度创新提出了流转主体的经济性和平等性、流转客体的完整性和明确性、流转过程的规范性，流转管理的统一性、透明性和服务性及流转行为的市场性要求．     

Markedness and its Interpretation in Language Use

Language markedness is a common phenomenon in languages, and is reflected from hearing, vision and sense, i.e. the variation in the three aspects such as phonology, morphology and semantics. This paper focuses on the interpretation of markedness in language use following the three perspectives, i.e. pragmatic interpretation, psychological interpretation and cognitive interpretation, with an aim to define the function of markedness.

Language is a means of verbal communication. People use language to communicate with each other. In the society, no two speakers are exactly alike in the way of speaking. Some differences are due to age, gender, statue and personality. Above all, gender is one of the obvious reasons. The writer of this paper tries to describe the features of women＇s language from these perspectives： pronunciation, intonation, diction, subjects, grammar and discourse. From the discussion of the features of women＇s language, more attention should be paid to language use in social context. 低渗透非均质砂岩油藏启动压力梯度研究

理论推导与室内实验相结合,建立了低渗透非均质砂岩油藏启动压力梯度确定方法。首先借助油藏流场与电场相似的原理,推导了非均质砂岩油藏启动压力梯度计算公式。其次基于稳定流实验方法,建立了非均质砂岩油藏启动压力梯度测试方法。结果表明:低渗透非均质砂岩油藏的启动压力梯度确定遵循两个等效原则。平面非均质油藏的启动压力梯度等于各级渗透率段的启动压力梯度关于长度的加权平均;纵向非均质油藏的启动压力梯度等于各渗透率层的启动压力梯度关于渗透率与渗流面积乘积的加权平均。研究成果可用于有效指导低渗透非均质砂岩油藏的合理井距确定,促进该类油藏的高效开发。
