调解机制与行政纠纷解决——一个基于法社会学视角的初步认识

多种非正式的协商、和解与调解机制在现代西方国家行政纠纷解决过程中被广泛运用,我国传统的以裁判方式解决行政纠纷的方式正面临严峻的挑战和制度变迁。借鉴法社会学关于“纠纷三阶段”理论分析,我国的行政纠纷解决过程引入调解机制不存在理论和技术上的障碍,应当尽快修改《行政复议法》和《行政诉讼法》中排斥调解的有关规定。     

论我国诉讼外纠纷调解机制之建构

调解是化解纠纷、维护稳定、促进社会和谐的重要手段.我国形成了事实上的司法、行政、民间调解的调解体系,然而并未建立起体系化的纠纷调解机制,尤其是对诉讼外的纠纷调解机制重视不够.诉讼外纠纷调解制度由于其高效率、低成本,消除纠纷的独立性、彻底性等特点,在整个调解制度框架中占据重要地位.     

论农村土地承包纠纷非诉讼调解机制的建构

农村土地承包纠纷调解机制的构建及其有效运行,对及时、有效和妥善解决农村土地承包纠纷,稳定农村土地基本经营制度,保障农民土地承包经营权,构建和谐的社会主义新农村等来说无疑有着十分重要的现实意义.应从构建有效的农村土地承包纠纷调解机制之必要性出发,着力解决土地承包纠纷调解机制构建中调解模式的设定、调解程序的配置和调解协议的效力等问题.     

完善价格争议行政调解机制的几点思考

针对当前价格纠纷日益增多的现状,价格部门要发挥公共服务职能,积极尝试开展价格争议行政调解工作,及时化解价格纠纷,避免矛盾激化,促进社会和谐。价格争议行政调解作为一项崭新工作,尚存在调解机构不健全、工作机制不完善、调解范围和效力有限、经费保障缺乏等问题。该文总结近几年工作实践和借鉴省内外经验,提出完善价格争议行政调解机制建议,推进价格争议行政调解专业化和规范化。     

关于制定我国《行政调解法》的构想

行政调解作为行政司法的一种调解制度,在处理行政纠纷和民事纠纷及经济纠纷等方面,越来越显现出重要作用。在我国大力发展社会主义市场经济、提倡建设和谐社会的今天,有必要制定适合我国国情的《行政调解法》。本文着重从行政调解的原则、主体、范围、效力等方面对行政调解立法进行提出建议,从立法层面对行政调解制度进行规制,进一步发展和完善我国的行政调解制度。

伴随单位社会的解体和社区体制的形成,各种社会问题集中到了社区,社区成为各种利益、矛盾的交汇点。社会问题社区化的一个集中体现就是当前社区民间纠纷频发、纠纷主体多样化、程度不断升级,这迫切需要行之有效的调解机制来应对。社区民间纠纷调解体系主要包括人民调解、行政调解、司法调解三种形式,它们之间是相互独立又相互联系、相互融合的。

与其它非诉纠纷解决机制相比,公安行政调解具有独特的优势。但公安行政调解尚存在违反自愿原则、扩大调解范围、调解与处罚并用等问题,因此,我们应当科学定位并合理规范公安行政调解行为,以化解矛盾与纠纷,推动基层基础建设,增进社会和谐。     

我国环境纠纷行政调解制度的完善探析

环境纠纷行政调解制度作为环境纠纷的一大利器，其本身拥有着环境诉讼所不具有的优势．对解决我国环境纠纷起着不可忽视的作用．然而其本身也有着不足。弥补这些不足．使环境纠纷行政调解发挥更好的作用。     

Markedness and its Interpretation in Language Use

Language markedness is a common phenomenon in languages, and is reflected from hearing, vision and sense, i.e. the variation in the three aspects such as phonology, morphology and semantics. This paper focuses on the interpretation of markedness in language use following the three perspectives, i.e. pragmatic interpretation, psychological interpretation and cognitive interpretation, with an aim to define the function of markedness.     

Features of Women's language

Language is a means of verbal communication. People use language to communicate with each other. In the society, no two speakers are exactly alike in the way of speaking. Some differences are due to age, gender, statue and personality. Above all, gender is one of the obvious reasons. The writer of this paper tries to describe the features of women＇s language from these perspectives： pronunciation, intonation, diction, subjects, grammar and discourse. From the discussion of the features of women＇s language, more attention should be paid to language use in social context. What＇s more, the linguistic phenomena in a speaking community can be understood more thoroughly.     

低渗透非均质砂岩油藏启动压力梯度研究

理论推导与室内实验相结合,建立了低渗透非均质砂岩油藏启动压力梯度确定方法。首先借助油藏流场与电场相似的原理,推导了非均质砂岩油藏启动压力梯度计算公式。其次基于稳定流实验方法,建立了非均质砂岩油藏启动压力梯度测试方法。结果表明:低渗透非均质砂岩油藏的启动压力梯度确定遵循两个等效原则。平面非均质油藏的启动压力梯度等于各级渗透率段的启动压力梯度关于长度的加权平均;纵向非均质油藏的启动压力梯度等于各渗透率层的启动压力梯度关于渗透率与渗流面积乘积的加权平均。研究成果可用于有效指导低渗透非均质砂岩油藏的合理井距确定,促进该类油藏的高效开发。
