略论不起诉决定的效力

不起诉决定的效力，是指检察官依法作出的不起诉决定所具有的拘束力、确定力和执行力。不起诉决定是检察机关依据刑事实体法和程序法作出的一种独立的司法决定，必然在实体法和程序法上产生相应的法律效力。基于对司法权威、司法公正和无罪推定原则以及一事不再理原则的客观分析，本文认为，生效的不起诉决定对案件当事人、人民检察院以及其他社会主体的行为产生约束力，在程序法上具有终止诉讼的效力，在实体法上具有推定无罪的效力。同时具有执行内容的不起诉决定还有强制执行的效力。     

论刑事一事不再理原则适用的客观范围

一事不再理原则是联合国刑事司法准则之一，但是对一事不再理原则的“一事”之范围的理论与实践却存在较大的差异。文章借鉴两大法系主要国家刑事司法理论与实践，结合我国刑事实体法和程序法，对一事不再理原更《适用的“亭、人、时间”及其例外与扩张情形展开探讨，认为一事不再理原则适用于“同一性之公诉事实”及受刑事指控之嫌疑人、被告人，于裁判确定后发生效力，以有利于被告原则为例外，扩张于刑事诉讼的各个阶段。     

再议程序法与实体法的关系

一、前言“以程序公正求实质正义,实质正义存;以实质正义践踏程序公正,则程序公正亡,实质正义也亡1”。只有程序法才能实现“法治当大2”。虽然程序法较之实体法更具有操作性,但这并不能立即说明程序法决定了实体法,因为“如果事物的表现形式和事物的本质会直接合而为一,一切科学就都成为多余的了3”。二、程序法与实体法的统一“实体法是指规定实体权利义务的法律,而程序法是指规定实现权利义务的方式和条件的法律4”我们不难看出二者之间的最基本的统一关系。(一)、程序法与实体法均为法律分支,共同服务于法律的目的。1、是治理国家的工具…

刑事不起诉制度是刑事诉讼的一项重要制度。现行不起诉制度在保障人权、节约司法资源、教育挽救犯罪人等方面产生了积极的作用,其价值和意义不容置疑。但是,随着司法实践的深入,不起诉制度在立法上存在疏漏与不足逐渐显露出来,严重制约了不起诉政策的功效。因此,必须从立法上重构和完善不起诉制度。     

推定问题研究

推定作为一项证据规则,被世界各国广泛运用。推定横跨程序法和实体法两个领域,我国三大诉讼法没有明确规定这一规则,法学界对其也未给予足够的重视,导致在司法实践中产生了不同程度的混乱。我国在立法中应当建立推定规则,明确推定事项,设立科学的推定程序,对于完善我国诉讼制度和解决实践中的司法实务具有及其重要的意义。     

大学生法律素质教育教学体系探究

法律素质是思想政治教育的核心内容和大学生必备的基本素质之一。目前“基础”课教师在大学生法律素质教育教学中遇到了教材内容十分丰富而课时较少和自身法律知识欠缺的困难。《思想道德修养与法律基础》法律方面的内容由三部分组成：法学基础理论、实体法、程序法。法律部分的教学应遵循两个原则：不拆分原则和实用原则。从教学模式上说，法理学部分宜采用影像教学法、特例教学法、对比教学法；实体法部分可采用法条分析、经典案例剖析和疑难案件探究法；程序法的教学模式是模拟法庭、差异分析。     

关于巨额财产来源不明罪几个问题的探析

巨额财产来源不明罪在我国刑法理论及司法实践中有很多问题都存在着争议。本罪的设立具有实体法和程序法两方面的积极价值,起到了严密法网、堵塞漏洞的作用;本罪的客体是国家工作人员职务行为的廉洁性,主观方面是一种严格责任,不需要考察被告人的主观罪过;本罪由司法机关和被告人共同承担证明责任。

摘教育主管部门签章同意毕业生与用人单位签订的就业协议,该签章行为在行为模式上区别于行政合同,应界定为行政审批。就业协议中的行政行为在行为性质上属于人事管理的行为,具有司法审查的可能性,但存在许多法律适用上的空白和判决生效后执行上的困难,目前亟待程序法和实体法的规范。     

Markedness and its Interpretation in Language Use

Language markedness is a common phenomenon in languages, and is reflected from hearing, vision and sense, i.e. the variation in the three aspects such as phonology, morphology and semantics. This paper focuses on the interpretation of markedness in language use following the three perspectives, i.e. pragmatic interpretation, psychological interpretation and cognitive interpretation, with an aim to define the function of markedness.     

低渗透非均质砂岩油藏启动压力梯度研究

理论推导与室内实验相结合,建立了低渗透非均质砂岩油藏启动压力梯度确定方法。首先借助油藏流场与电场相似的原理,推导了非均质砂岩油藏启动压力梯度计算公式。其次基于稳定流实验方法,建立了非均质砂岩油藏启动压力梯度测试方法。结果表明:低渗透非均质砂岩油藏的启动压力梯度确定遵循两个等效原则。平面非均质油藏的启动压力梯度等于各级渗透率段的启动压力梯度关于长度的加权平均;纵向非均质油藏的启动压力梯度等于各渗透率层的启动压力梯度关于渗透率与渗流面积乘积的加权平均。研究成果可用于有效指导低渗透非均质砂岩油藏的合理井距确定,促进该类油藏的高效开发。
