我国刑事立法中有关被告人诉讼权利的缺失

随着世界各国诉讼机制的日趋成熟，国际社会对人权保障问题越来越关注，我们可以看出在我国刑事立法中对于保障被告人诉讼权利的规定存在不足。根据目前司法实践中出现的几种严重问题，我们应从立法上明确保障被告人所享有的诉讼权利。     

论农民工子女受教育权的保障

受教育权是一项基本人权。中华人民共和国公民有受教育的权利和义务。农民工群体数量庞大,如果解决不好农民工子女的受教育问题,可能会引发诸多的社会问题。因此,要采取相应措施保障农民工子女的受教育权。     

农民工权利保护现状

由于农民工身份地位的特殊性,农民工权利遭遇侵害的事件时有发生,农民工的权利并没有得到有效的保障。本文旨在考察农民工权利法律保护的现状,以其对进一步探索加强农民工权利法律保护提供借鉴。     

论人权的司法补救

人权是人作为人所具有或应当具有的一切权利的总称，这一概念包容性极强，层次也很繁杂，具有普遍性和多样性，道德性和法治性，应然性和实然性，抽象性和具体性。司法是保障人权最基本，最重要和最终的途径，但司法保障的人权仅限于法治意义上的人权，即法律权利，其前提是法院审判要公正独立以及政府行为具有可诉性。其基本理论基础是诉权或获得司法审判权是现代法制中第一制度性人权，随着时代的发展，人权的司法补救也具有了重要的国际意义。最后简略谈谈中国的人权补救现状及努力方向。

从人权的视角来看,大学生不仅拥有法律权利,也拥有道德权利。因此,高校不仅要保障大学生的法律权利,也要尊重其道德权利。大学生的道德权利,既是应然权利,也是实在权利。教育要坚持以人为本的理念,就必须确立人文关怀的核心地位,彻底改变原来那种＂无人＂的教育,站在人权视角和高度,以宽容、理性、尊重和平等的胸怀开展道德教育活动,维护与保障大学生的道德权利。     

农民工社会保障问题的法律透视

农民工的社会保障问题，是社会主义市场经济建设中的一个重要内容。农民工社会保障缺失由诸多因素造成。建立健全农民工社会保障相关法律制度意义重大。农民工社会保障问题应从工伤保障，医疗保障，最低生活保障，养老保险等方面逐步加以解决。     

构建我国非法证据排除规则的基本设想

近年来随着对人权保障的重视,非法证据的采信问题逐渐被司法界所关注.排除非法证据虽然可能造成客观真实的失落,但却为树立权利保障观念、正当程序观念提供了一种保障.因此,在我国有必要完善该规则的法律体系.     

试论将被害人作为国际刑法的主体进行研究的合理性与必要性

打击国际犯罪和维护基本人权均是国际刑法的重要内容,但是研究人员们更多的关注了犯有国际罪行的主体,而常常忽视了对被害人的权益保障。国家刑法已经逐渐展开了对被害人主体问题的研究,保护被害人的权利也是人权保障的基本要求。作为综合了国际法、国家刑法、国际人权法等内容的学科,国际刑法保障被害人主体的权益是合理的,也是必要的。     

Markedness and its Interpretation in Language Use

Language markedness is a common phenomenon in languages, and is reflected from hearing, vision and sense, i.e. the variation in the three aspects such as phonology, morphology and semantics. This paper focuses on the interpretation of markedness in language use following the three perspectives, i.e. pragmatic interpretation, psychological interpretation and cognitive interpretation, with an aim to define the function of markedness.     

Features of Women's language

Language is a means of verbal communication. People use language to communicate with each other. In the society, no two speakers are exactly alike in the way of speaking. Some differences are due to age, gender, statue and personality. Above all, gender is one of the obvious reasons. The writer of this paper tries to describe the features of women＇s language from these perspectives： pronunciation, intonation, diction, subjects, grammar and discourse. From the discussion of the features of women＇s language, more attention should be paid to language use in social context. What＇s more, the linguistic phenomena in a speaking community can be understood more thoroughly.     

低渗透非均质砂岩油藏启动压力梯度研究

理论推导与室内实验相结合,建立了低渗透非均质砂岩油藏启动压力梯度确定方法。首先借助油藏流场与电场相似的原理,推导了非均质砂岩油藏启动压力梯度计算公式。其次基于稳定流实验方法,建立了非均质砂岩油藏启动压力梯度测试方法。结果表明:低渗透非均质砂岩油藏的启动压力梯度确定遵循两个等效原则。平面非均质油藏的启动压力梯度等于各级渗透率段的启动压力梯度关于长度的加权平均;纵向非均质油藏的启动压力梯度等于各渗透率层的启动压力梯度关于渗透率与渗流面积乘积的加权平均。研究成果可用于有效指导低渗透非均质砂岩油藏的合理井距确定,促进该类油藏的高效开发。
