国际反倾销与中国之对策研究

倾销和反倾销问题是近年来在整个国际经济法学界争论较多,也比较激烈的一个热点问题。针对我国的出口,国外常采用反倾销调查这一手段,对于我国这样一个政治经济高度发展的发展中国家而言,如何更加清楚地了解有关倾销与反倾销的相关法律法规和国际通行惯例,将是一个十分重要的问题。本文拟通过分析当今世界各国倾销和反倾销的现状来深入探讨我国应该如何应对反倾销这一棘手问题。

“反倾销反补贴”有了司法解释最高人民法院近日公布了《关于审理反倾销行政案件应用法律若干问题的规定》和《关于审理反补贴行政案件应用法律若干问题的规定》两个司法解释，分别对司法审查的范围、诉讼参加人、管辖、司法审查的标准、举证责任、判决方式等作出规定，第一次明确了我国人民法院承担对国务院主管部门反倾销、反补贴行政行为进行司法审查的重要职责。这两个司法解释，对于人民法院承担世贸组织规则和我国加入世贸组织法律文件规定的司法审查职责，保护参与反倾销、反补贴调查程序的组织和个人的合法权益，依法监督和维护反倾…     

我国遭受反倾销调查的现状与对策分析

入世以来，我国面临着越来越多的反倾销调查。文章从倾销与反倾销的定义入手，结合近十年遭遇反倾销调查的情况，通过分析成因，提出我国企业避免遭受反倾销调查的有效措施。

对当事人问题进行研究,对于民事诉讼立法和民事诉讼实践具有指导意义,它有助于在立法上对当事人作出科学的规范,进而有助于在实践中对案件作出恰当的处理。当今,我国的法律理论界对当事人有关问题的规定存在许多弊端,在实践中涉及诸多方面。对有关当事人的定义、分类以及更换的问题所进行的一些探讨对今后的立法修改有一定参考价值。

Markedness and its Interpretation in Language Use

Language markedness is a common phenomenon in languages, and is reflected from hearing, vision and sense, i.e. the variation in the three aspects such as phonology, morphology and semantics. This paper focuses on the interpretation of markedness in language use following the three perspectives, i.e. pragmatic interpretation, psychological interpretation and cognitive interpretation, with an aim to define the function of markedness.     

Features of Women's language

Language is a means of verbal communication. People use language to communicate with each other. In the society, no two speakers are exactly alike in the way of speaking. Some differences are due to age, gender, statue and personality. Above all, gender is one of the obvious reasons. The writer of this paper tries to describe the features of women＇s language from these perspectives： pronunciation, intonation, diction, subjects, grammar and discourse. From the discussion of the features of women＇s language, more attention should be paid to language use in social context. What＇s more, the linguistic phenomena in a speaking community can be understood more thoroughly.     

低渗透非均质砂岩油藏启动压力梯度研究

理论推导与室内实验相结合,建立了低渗透非均质砂岩油藏启动压力梯度确定方法。首先借助油藏流场与电场相似的原理,推导了非均质砂岩油藏启动压力梯度计算公式。其次基于稳定流实验方法,建立了非均质砂岩油藏启动压力梯度测试方法。结果表明:低渗透非均质砂岩油藏的启动压力梯度确定遵循两个等效原则。平面非均质油藏的启动压力梯度等于各级渗透率段的启动压力梯度关于长度的加权平均;纵向非均质油藏的启动压力梯度等于各渗透率层的启动压力梯度关于渗透率与渗流面积乘积的加权平均。研究成果可用于有效指导低渗透非均质砂岩油藏的合理井距确定,促进该类油藏的高效开发。
