民生保障的法治困境及其破解

民生是法治建设的价值目标,法治为民生提供切实保障,民生保障法治化是构建和谐社会的必然要求。我国民生法治建设取得了较大成就,但由于立法供给的不足、执法的失范、司法救助渠道的阻滞,民生保障法治化的发展仍遭遇重重困境。加强法治建设、夯实民生保障的法治根基,是保障民生的基础工程。完善民生保障法治系统要求健全立法、严格执法和公正司法。     

加快推进行政执法体系改革的研究

行政执法水平和质量的高低是政府依法行政水平和质量的缩影。当前,行政执法体系在法律法规、体制机制、执法保障、"两法"衔接、执法监督和执法水平等方面存在着与执法形势、执法任务不相适应的问题。加快推进行政执法体系改革已成为建设法治政府的迫切需要,文章在充分调研的基础上,提出改革的一些可行性建议。     

关于“阳光量刑”问题的理论研究——量刑规范化改革的实践综述

"阳光量刑"是我国当代司法改革的直接产物,它是人们对人民法院量刑规范化改革的喻称。"阳光量刑"可界定为:通过量刑规范化改革,置量刑活动于公开透明之下,使法官的量刑权受制于公正的量刑制度,以人们看得见的方式实现量刑公正、均衡。"阳光量刑"的实施既是解决司法实践中量刑突出问题的现实需要,也是推进法治进步、建设法治中国的时代需要。"阳光量刑"的实践探索过程包括萌芽、正式提出与试点、全面试行和总结升华四个阶段。"阳光量刑"的实践在量刑制度建设和规范量刑的实际效果方面都取得了好的成果,但也存在一定问题,需要采取措施进一步加以解决。     

我国农村法治建设若干问题探析

农村法治建设是依法治国的重要基础,在我国现阶段农民法律意识落后,农村的立法、执法及司法中存在着许多问题,农民平等权益得不到有力保护,因此要加强党的领导,健全农村立法,加大执法和司法大度,培养农民现代法律意识,解决农村突出现实问题,树立法律权威。     

论司法公正的影响因素及其实现途径

司法不公正是影响社会和谐稳定的一大因素。而司法不公正的原因主要在于司法人员认为“不必公正”、“不敢公正”或者“不愿公正”。因此,实现司法公正必须提升司法权威,改革司法体制,提高司法队伍素质,让司法人员重视公正、敢于公正、愿意公正,真正使司法公正成为维护社会公正的最重要的防线,成为构建社会主义和谐社会的基础性保障。     

量刑规范化改革中检察机关相关问题探析——以检察机关量刑建议为视角

量刑规范化作为我国一项重要的司法改革任务,其改革成败关乎刑事法治能否顺利实现以及量刑公正是否得到有效保障。检察机关的量刑建议作为量刑规范化改革中的制度设计之一,有其存在的法理、法律依据以及价值内涵。量刑建议在司法实践中运用的充分、得当与否,也在一定程度决定着量刑规范化改革＂触角＂的深浅,但是量刑建议作为人民检察院公诉权延伸,在实际操作过程中存在合法律性遭质疑、说理不足、标准不明确、配套制度不健全等问题,需要不断健全与完善。     

内部整合改革背景下的主办检察官办案责任制实践探析——以黄石市下陆区人民检察院为例

党的十八届三中全会明确提出"建设法治中国,必须深化司法体制改革,确保依法、独立、公正行使审判权、检察权,健全司法权力运行机制。"为全面贯彻中共中央关于深化司法改革的精神,2012年,下陆区人民检察院在整合机构的基础上进一步整合人员,探索推进了主办检察官办案责任制改革,在优化检察权的二次配置、强化队伍专业化建设、提升司法公信力方面做出了有益探索。但改革中也存在诸多问题,需要从提高主办精英化程度等方面进一步改进。     

强化行政审判工作 加快依法治国步伐

加强行政审判工作,是依法治国,建设社会主义法治国家的战略需要,重点应放在依法治权、依法治官、依法保护行政相对方的合法权益上。当前应着力从三个方面入手:一要以牢固树立民本观为立足点,讲正气,坚持正义,大力改善执法环境;二要以改革为动力,加大司法改革的力度,积极推行审判长和独任审判员负责制,强化合议庭职责,建立健全公正高效的行政审判运行机制;三要以抓队伍建设为根本,严肃执法,公正司法,为人民群众高擎一片蓝天。     

健全公正执法与改革司法体制的思考

中国司法制度所面临的若干问题常常与制度建构方面的缺陷有关。这些问题的存在严重影响了公正执法，损害了司法机关的形象，妨碍了司法工作的健康发展，司法体制改革应当把树立司法的权威性和维护司法的统一性作为司法体制改革的首要目标；把清除执法中的地方保护主义作为推进司法体制改革的重要内容；把培养高素质的执法司法队伍作为维护司法公正的关键。     

依法独立公正行使审判权检察权的政治与制度保障

依法独立公正行使审判权、检察权是司法体制改革的核心内容,是法治中国建设进程中必须切实加以解决的司法权运行的基础性问题。依法独立公正行使审判权、检察权的实现,党的领导是政治保障;深化司法体制改革,建设公正高效权威的社会主义司法制度是制度保障。两大保障体系的建设应当齐头并进,不可错置和偏移。政治保障要从坚持和改善党的领导入手,制度保障要从司法管理体制、司法人员管理制度、落实司法责任、推进阳光司法、加强监督机制等方面发力,共同筑成依法独立公正行使审判权、检察权的保障体系。     

Markedness and its Interpretation in Language Use

Language markedness is a common phenomenon in languages, and is reflected from hearing, vision and sense, i.e. the variation in the three aspects such as phonology, morphology and semantics. This paper focuses on the interpretation of markedness in language use following the three perspectives, i.e. pragmatic interpretation, psychological interpretation and cognitive interpretation, with an aim to define the function of markedness.     

Features of Women's language

Language is a means of verbal communication. People use language to communicate with each other. In the society, no two speakers are exactly alike in the way of speaking. Some differences are due to age, gender, statue and personality. Above all, gender is one of the obvious reasons. The writer of this paper tries to describe the features of women＇s language from these perspectives： pronunciation, intonation, diction, subjects, grammar and discourse. From the discussion of the features of women＇s language, more attention should be paid to language use in social context. What＇s more, the linguistic phenomena in a speaking community can be understood more thoroughly.     

低渗透非均质砂岩油藏启动压力梯度研究

理论推导与室内实验相结合,建立了低渗透非均质砂岩油藏启动压力梯度确定方法。首先借助油藏流场与电场相似的原理,推导了非均质砂岩油藏启动压力梯度计算公式。其次基于稳定流实验方法,建立了非均质砂岩油藏启动压力梯度测试方法。结果表明:低渗透非均质砂岩油藏的启动压力梯度确定遵循两个等效原则。平面非均质油藏的启动压力梯度等于各级渗透率段的启动压力梯度关于长度的加权平均;纵向非均质油藏的启动压力梯度等于各渗透率层的启动压力梯度关于渗透率与渗流面积乘积的加权平均。研究成果可用于有效指导低渗透非均质砂岩油藏的合理井距确定,促进该类油藏的高效开发。
