自我、权利与正义——与约翰·密尔自由主义相关的三个问题

自由主义有着许多不同形态.在自我、权利与正义这三个当代政治哲学关心的核心议题上,密尔式自由主义都给出了与康德式自由主义非常不同的思考.密尔认为自我既不是一种超越于经验之上的先验性个体,又不是一种必须依附于所处社群而存在的身份性个体.密尔将权利与善的关系转化成了自由与善的关系,自由能够让善多元化.密尔的功利原理不仅仅是一种道德原理,正义在道德领域具有首要性,但在整个功利原理当中并不占据着核心位置.密尔式自由主义能够提供一种为自由主义辩护的新思路.     

马克思权利观的两次转变及其理论意义

马克思的权利观是马克思法哲学思想的重要组成部分,其理论观点经历了前后两个阶段,呈现出两次理论转向。第一次理论转向是受康德自由主义的权利法哲学影响,提出了"法的形而上学思想"、"形式法与实体法的学说",这一时期的权利观理论带有明显的理性主义色彩,主张人的理性行为与自由权利的不可分性,高度重视人的自由在法律上的重要性。第二次理论转向是运用历史唯物主义的理论,反思与批判青年黑格尔主义的法学观点,把权利看作是一个社会历史现象,主张权利问题的社会历史性与物质制约性。马克思权利观的转向对于当前我国的法治建设与权利观培育有着十分重要的理论意义。

论存在自由与人性自由

作为人类最高价值与文化的自由价值，“存在自由”与“人性自由”共同构成人类自由价值母题的双重言说方式。存在自由是指主体存在所获得或享有的自由价值与自由权利，而人性自由则是指人类自由自觉生命活动的本质力量自由。以多义性的“自由”概念来解读西方自启蒙运动以来作为社会主流意识形态与基本组织结构的自由主义学说，势必陷入学理含混与意图谬见之中，从而导致西方自由主义言说的“中国化”症结。

马克思法律思想自由观的历史演变

马克思从早期的客观唯心主义逐渐走向了历史唯物主义,从早期的自由主义法学观逐渐走向了实践的自由观,并预言社会最终阶段将是一个个人能力全面而自由发展的自由王国。其所建构的共产主义─—关于人的发展前景的美好未来中,法律最终消亡,自由得到飞跃发展。     

从消极自由到积极自由——论密尔的自由主义

密尔是古典自由主义集大成者,他的自由理论既总结了传统自由主义,又开启了向新自由主义转变的历史潮流.当古典自由主义在当代复兴时,另一位自由主义大师柏林对自由概念进行了积极自由与消极自由的区分,并认为密尔是消极自由最典型的代表,但运用这两种自由概念对密尔的自由主义进行重新解读时,发现密尔的自由主义中存在着积极自由因素:密尔把人的社会生活划分为私人领域和公共领域,在私人领域,个人的自由是去做什么的自由,即积极自由;而在公共领域,个人的自由是免于做什么的自由,即消极自由.因此,不能将密尔完全视为消极自由者,而无视他自由思想中的积极自由的一面.

Markedness and its Interpretation in Language Use

Language markedness is a common phenomenon in languages, and is reflected from hearing, vision and sense, i.e. the variation in the three aspects such as phonology, morphology and semantics. This paper focuses on the interpretation of markedness in language use following the three perspectives, i.e. pragmatic interpretation, psychological interpretation and cognitive interpretation, with an aim to define the function of markedness.     

Features of Women's language

Language is a means of verbal communication. People use language to communicate with each other. In the society, no two speakers are exactly alike in the way of speaking. Some differences are due to age, gender, statue and personality. Above all, gender is one of the obvious reasons. The writer of this paper tries to describe the features of women＇s language from these perspectives： pronunciation, intonation, diction, subjects, grammar and discourse. From the discussion of the features of women＇s language, more attention should be paid to language use in social context. What＇s more, the linguistic phenomena in a speaking community can be understood more thoroughly.     

低渗透非均质砂岩油藏启动压力梯度研究

理论推导与室内实验相结合,建立了低渗透非均质砂岩油藏启动压力梯度确定方法。首先借助油藏流场与电场相似的原理,推导了非均质砂岩油藏启动压力梯度计算公式。其次基于稳定流实验方法,建立了非均质砂岩油藏启动压力梯度测试方法。结果表明:低渗透非均质砂岩油藏的启动压力梯度确定遵循两个等效原则。平面非均质油藏的启动压力梯度等于各级渗透率段的启动压力梯度关于长度的加权平均;纵向非均质油藏的启动压力梯度等于各渗透率层的启动压力梯度关于渗透率与渗流面积乘积的加权平均。研究成果可用于有效指导低渗透非均质砂岩油藏的合理井距确定,促进该类油藏的高效开发。
