浅析网络著作权侵权责任

网络技术的飞速发展和互联网的成熟,不仅诱发了信息交流方式的革命,而且给传统的著作权制度带来了新的挑战,导致众多网络侵权的发生。网络著作权侵权行为有其特殊性,因此如何建立一套制约相关各方权利、平衡各方利益的法律制度,合理保护权利人的利益,对网络服务提供者的侵权行为进行有效的制裁,同时又能够保证网络产业的健康发展至关重要。     

论网络信息著作权的刑法保护

随着科学技术的迅速发展,信息网络周知面的快速扩大,针对网络信息著作权的侵权行为不断出现,方式不断更新。虽然我国对于网络信息著作权的刑法保护正在逐步完善,但还有许多新问题需要得到规范,以进一步加强国家对网络信息著作权的刑法保护力度。作为最为严厉也是最后一道保护屏障的刑法来说,预防和遏制侵犯著作权犯罪是当务之急。该文主要从网络信息著作权的范畴,侵犯网络信息著作权的构成要件及责任认定,现行《刑法》对网络信息著作权刑法保护的现状、缺陷及完善对策等方面加以论述并作出分析。

在涉及著作权各方利益、社会文化发展利益的前提下,各国法律都普遍承认了著作权的合理使用制度。以求得总体利益最大化的制度安排。随着我国经济的不断发展和进入网络时代以后,我国《著作权法》22条关于著作权合理制度规定的具体情形也面临着新的挑战。通过对著作权合理使用制度在新环境下的法律适用和网络环境下的问题分析,以期对解决网络环境下的著作权合理使用制度有所帮助。

网络著作权是以传统著作权为基础派生出来的概念,网络信息技术特有的共享性、多元性、互动性、即时性等特点刷新了知识扩散和信息传输的方式,除了附着于纸质载体上的传统意义上的知识作品,还出现了表现为数字代码形式的数字化作品,延伸了著作权保护客体的领域,使得现有的著作权法律出现保护空白,令著作权保护制度面临着全新维度的挑战;同时,网络服务的共享性与著作权的专有性发生冲突,简单易上手的操作系统与监管的疏失为著作权侵权行为打开了方便之门,于是网络著作权侵权案件频频发生。加强网络环境下的著作权保护,首先应该完善著作权保护法律,结合技术措施,加强著作权集体管理机构体系性设计,从而多角度、宽领域地实现网络著作权的保护。

论著作权法的三元权利构建模式——使用者权初论

中国著作权法法律体系中主要包含三种法益,即狭义著作权人的利益,传播者的利益,以及使用者的利益。然而只有前两种利益的主体被明确赋予权利,即狭义著作权和邻接权。使用者的利益无权利保障。使用者权利的失位加剧了三种法益的失衡,结果是著作权范围的急速扩张,社会公众利益受损。著作权法应当明确、适当地赋予使用者一定的权利,以实现著作权的非财产权化,以唤醒社会公众的权利意识,以解决技术措施带来的法益失衡,复建三类主体之间的有效对抗,重塑均衡博弈,进而实现著作权法的立法宗旨。     

略论网络著作权侵权及法律保护

随着网络技术的不断发展,著作权保护的范围和内容不断扩大和深化,由此引发的著作权侵权纠纷时有发生.我国目前关于著作权保护的法律、法规相对滞后.文章从网络著作权侵权的概念、特征入手,分析了网络著作权侵权行为及法律责任,阐述了我国网络著作权立法的概况及其不足之处,从立法建议、完善著作权集体管理制度等方面着重探讨了网络著作权的法律保护.     

Markedness and its Interpretation in Language Use

Language markedness is a common phenomenon in languages, and is reflected from hearing, vision and sense, i.e. the variation in the three aspects such as phonology, morphology and semantics. This paper focuses on the interpretation of markedness in language use following the three perspectives, i.e. pragmatic interpretation, psychological interpretation and cognitive interpretation, with an aim to define the function of markedness.     

Features of Women's language

Language is a means of verbal communication. People use language to communicate with each other. In the society, no two speakers are exactly alike in the way of speaking. Some differences are due to age, gender, statue and personality. Above all, gender is one of the obvious reasons. The writer of this paper tries to describe the features of women＇s language from these perspectives： pronunciation, intonation, diction, subjects, grammar and discourse. From the discussion of the features of women＇s language, more attention should be paid to language use in social context. What＇s more, the linguistic phenomena in a speaking community can be understood more thoroughly.     

低渗透非均质砂岩油藏启动压力梯度研究

理论推导与室内实验相结合,建立了低渗透非均质砂岩油藏启动压力梯度确定方法。首先借助油藏流场与电场相似的原理,推导了非均质砂岩油藏启动压力梯度计算公式。其次基于稳定流实验方法,建立了非均质砂岩油藏启动压力梯度测试方法。结果表明:低渗透非均质砂岩油藏的启动压力梯度确定遵循两个等效原则。平面非均质油藏的启动压力梯度等于各级渗透率段的启动压力梯度关于长度的加权平均;纵向非均质油藏的启动压力梯度等于各渗透率层的启动压力梯度关于渗透率与渗流面积乘积的加权平均。研究成果可用于有效指导低渗透非均质砂岩油藏的合理井距确定,促进该类油藏的高效开发。
