鉴于污染海洋行为具有严重的社会危害性，着重就增设污染海洋罪的必要性、该罪的概念和构成特征、认定该罪应注意的问题等进行了论述。

浅析转化犯

转化犯的概念,应包括罪与罪之间的转化,非罪与罪之间的转化以及罪(非罪)与拟制罪之间的转化.转化犯构成必须具有前行为、后行为以及实施该行为过程中行为人主观上的故意要求,且行为应符合法定的转化条件.在转化犯的分类上,不应将拟制的转化犯脱离转化犯范畴,否则会造成司法实践和转化犯理论上的混乱.判断转化犯的标准应以转化犯的构成要件为主要依据.     

论渎职罪中的"前提罪"

本文对以"前提罪"作为构成条件的渎职罪进行了分析,界定了"前提罪"的概念,确定了"前提罪"的存在范围和分类,在此基础上,认为"前提罪"的确定标准应以行为人对作为对象的"前提罪"达到刑法分则所要求的明知,并进一步阐述了"前提罪"与关联渎职罪之间的犯罪形态和处罚原则.     

论工程重大安全事故罪

工程重大安全事故罪是现行刑法新增加的罪名,文章就增设本罪的必要性,本罪的构成特征,认识本罪应注意的问题,本罪罪名的确立以及本罪的完善等问题进行了论述。     

非法吸收公众存款罪的行为认定及其防控思考

社会转型期,整个社会心态处于游移和彷徨之中.非法吸收公众存款罪作为市场经济发展中产生的一种经济犯罪现象,与其它犯罪相比,更易激发社会矛盾,影响社会稳定.对非法吸收公众存款罪的行为认定应注意分析该罪行为的特点,揭示非法吸收公众存款罪隐蔽性更强,危害性更大等危害特征,并对非法吸收公众存款罪进行综合性的防控.     

论侵犯知识产权罪的刑法定位

对侵犯知识产权罪的概念和危害的进行分析,可证明侵犯知识产权罪是一种严重侵害他人私权和危害国家经济增长和人类进步的行为。我国刑法却将侵犯知识产权罪定位于轻微危害社会犯罪的范畴,对该罪的法定刑过轻。罪刑相当原则、适用刑罚的效益原则和TRIPS的要求决定了应将侵犯知识产权罪定位于严重危害社会的犯罪,并加重对该罪的刑罚。

抢劫枪支、弹药、爆炸物罪的犯罪主体应包括已满14周岁不满16周岁的人。该罪犯罪对象的范围应进行的界定。该罪既遂、未遂的标准应根据不同情况加以确定。     

关于破坏性采矿罪的若干问题

对破坏性采矿罪学者们多是以现行刑法的规定的内容作为其概念,但这样不是很准确,也不利于与非法采矿罪进行区分。对破坏性采矿罪的客观方面的特征,随着司法解释的出台也应该进行明确化,同时,也有助于在司法实践更好的区分破坏性采矿罪和非法采矿罪。     

Markedness and its Interpretation in Language Use

Language markedness is a common phenomenon in languages, and is reflected from hearing, vision and sense, i.e. the variation in the three aspects such as phonology, morphology and semantics. This paper focuses on the interpretation of markedness in language use following the three perspectives, i.e. pragmatic interpretation, psychological interpretation and cognitive interpretation, with an aim to define the function of markedness.     

低渗透非均质砂岩油藏启动压力梯度研究

理论推导与室内实验相结合,建立了低渗透非均质砂岩油藏启动压力梯度确定方法。首先借助油藏流场与电场相似的原理,推导了非均质砂岩油藏启动压力梯度计算公式。其次基于稳定流实验方法,建立了非均质砂岩油藏启动压力梯度测试方法。结果表明:低渗透非均质砂岩油藏的启动压力梯度确定遵循两个等效原则。平面非均质油藏的启动压力梯度等于各级渗透率段的启动压力梯度关于长度的加权平均;纵向非均质油藏的启动压力梯度等于各渗透率层的启动压力梯度关于渗透率与渗流面积乘积的加权平均。研究成果可用于有效指导低渗透非均质砂岩油藏的合理井距确定,促进该类油藏的高效开发。
