论“疑罪从无”和“发回重审”的冲突和对策

通过对"疑罪从无"和"发回重审"的利弊分析,提出了以"疑罪从无"为原则改革"发回重审"制度的若干建议,旨在消除法律制度冲突,最大限度地发挥刑事二审程序的纠错功能,维护当事人的合法权益。     

对我国刑事发回重审制度的反思

我国《刑事诉讼法》对发回重审的理由规定得不明确,没有限制发回重审的次数,且缺乏重要的配套制度,这致使司法实践中的发回重审确定性不强、随意性趋大,不仅容易导致循环审判,造成诉讼效率的下降,也忽视了对有关当事人尤其是被告人的权利救济,更难以彻底实现审判救济程序的目的。     

刑事诉讼法之再修改:结合实际,与时俱进——以基层法院司法实践为视角

为适应新时代刑事审判的需要,我国以刑法修正案方式八次对现行刑法予以修正,但是刑事诉讼法依然未予修改。基层法院在审理刑事案件的司法实践操作中遇到了一些困难和困惑,对刑事诉讼法的相关规定应当适应刑事实体法的修改与时俱进进行修改,如对刑诉法关于刑事附带民事诉讼的适用、简易、普通程序的适用以及检察机关的诉讼权限、抗诉、再审程序的规定等应作必要的修改。     

关于完善我国刑事和解制度的几点思考

新修订的《刑事诉讼法》增设了“当事人和解的公诉案件诉讼程序”,使争议多年的刑事和解制度在法律上得以正式建立,并将于明年开始实施,现最高人民法院正在就新《刑事诉讼法》司法解释公开征求意见。通过对我国刑事和解制度的解读,结合先期我国各地试行刑事和解的具体实践情况,针对实践中存在的案件适用少,诟病频的问题,从刑事和解的具体实施与建立配套制度方面提出解决办法,以期能进一步完善我国刑事和解制度,进而提高其法律效应和社会效应,推动和促进我国法治社会和和谐社会的建设。     

试论国际刑事法院管辖权补充性原则

国际刑事法院是世界上第一个常设国际刑事司法机构，其管辖权补充性原则直接影响着缔约国和非缔约国的权利和义务，关乎国际义务与国家主权的均衡协调。《罗马规约》对于管辖权补充性原则进行了多层次的规定和要求，但同时也存在有关非缔约国主权、案件不可受理性和“一罪不二审”的例外与冲突。对于检察官重复启动调查、起诉程序以及修改、追加指控或代之以较严重的指控的权力，应当实施限制次数和间隔时间的制约措施。     

我国刑事见证人法律地位问题调查与研究———以 H 省 Q 县为视角

对刑事见证人法律地位的明确以及资格的科学界定是程序正义的必然要求与具体体现,然而,《刑事诉讼法》的最新修订及其司法解释并没有完成这一任务。文章以H省Q县调查材料为基础对我国刑事见证人法律地位进行研究,为我国刑事见证制度的完善提供一定的方法和思路。     

刑事附带民事诉讼程序的缺陷及其完善

由于我国刑事诉讼法及相关司法解释对刑事附带民事诉讼的提起及具体程序规定不明确,导致司法实践中存在诸多缺陷,本文拟对刑事附带民事诉讼的提起、审理及执行程序方面存在的缺陷及完善略陈管见,以期对将来刑事诉讼法再修改有所帮助。     

辩护制度的完善与公安机关刑事执法

我国2012年修订的《刑事诉讼法》从辩护人的地位、责任、辩护权保障等方面对辩护制度作了重大修改完善。与之相适应,公安机关作为重要的刑事执法机关,应当清醒认识思想观念、立法和执法环境方面存在的问题。通过端正思想、提高认识,更新和转变执法理念、证据观念,建立与辩护人的良好互动关系,保障辩护人的诉讼权利等措施,积极应对辩护制度的修改与完善,不断提升刑事执法水平。     

刑事诉讼法在人权保障上的新跨越

新修订的《刑事诉讼法》最大的亮点就是：将尊重和保障人权正式写进了刑事诉讼法的总则当中,把它作为刑事诉讼法总的工作和基本的任务在法典中明确规定下来。刑事诉讼法素有“小宪法”“行动中的宪法”之称,刑事诉讼法已成为第一部宣告“保障人权”的国家基本法律。修改后的刑诉法在证据制度、强制措施、辩护制度、侦查措施、审判程序、特别程序都体现尊重和保障人权的原则。     

刑事被害人精神损害赔偿诉讼中的困境及超越

我国《刑事诉讼法》未将精神损害纳入刑事附带民事诉讼的范围。这一规定在司法运作过程中已经消解了刑事附带民事诉讼制度的价值，实际上已经限制了刑事被害人的诉权，不利于被害人权利的保护。我国应及早通过立法修改，将精神损害赔偿纳入刑事附带民事诉讼的范围，并对刑事附带民事诉讼规定相对较长的审理期限。     

Markedness and its Interpretation in Language Use

Language markedness is a common phenomenon in languages, and is reflected from hearing, vision and sense, i.e. the variation in the three aspects such as phonology, morphology and semantics. This paper focuses on the interpretation of markedness in language use following the three perspectives, i.e. pragmatic interpretation, psychological interpretation and cognitive interpretation, with an aim to define the function of markedness.     

Features of Women's language

Language is a means of verbal communication. People use language to communicate with each other. In the society, no two speakers are exactly alike in the way of speaking. Some differences are due to age, gender, statue and personality. Above all, gender is one of the obvious reasons. The writer of this paper tries to describe the features of women＇s language from these perspectives： pronunciation, intonation, diction, subjects, grammar and discourse. From the discussion of the features of women＇s language, more attention should be paid to language use in social context. What＇s more, the linguistic phenomena in a speaking community can be understood more thoroughly.     

低渗透非均质砂岩油藏启动压力梯度研究

理论推导与室内实验相结合,建立了低渗透非均质砂岩油藏启动压力梯度确定方法。首先借助油藏流场与电场相似的原理,推导了非均质砂岩油藏启动压力梯度计算公式。其次基于稳定流实验方法,建立了非均质砂岩油藏启动压力梯度测试方法。结果表明:低渗透非均质砂岩油藏的启动压力梯度确定遵循两个等效原则。平面非均质油藏的启动压力梯度等于各级渗透率段的启动压力梯度关于长度的加权平均;纵向非均质油藏的启动压力梯度等于各渗透率层的启动压力梯度关于渗透率与渗流面积乘积的加权平均。研究成果可用于有效指导低渗透非均质砂岩油藏的合理井距确定,促进该类油藏的高效开发。
