“赔偿减刑”的法经济学分析

"赔偿减刑"是在我国的司法实践中基于一定的国际和国内背景而产生的。该制度在司法实践中的良性运行无论对刑事被告人、被害人或其家属来说都是收益大于成本的,属于帕累托改进;对司法机关来说,也提高了司法效率。但由于立法的不完善,"赔偿减刑"的适用存在一定的风险。因此,必须通过完善立法、保证程序法设计的合理性与正义性以及加强法官的职业伦理道德建设等来保证"赔偿减刑"制度在司法实践中促进公平与正义的实现。     

论我国假释制度中存在的问题及其完善

假释制度在我国的执行情况表现为以减刑为主、假释为辅,其得不到＂重用＂之原因为其适用条件中的＂不致再危害社会＂条件会带来适用错误之风险,更为重要的原因为该制度存在实体条件设置与程序设计方面的不合理性。改变这种不利现状之对策在于从构建假释申请程序、设立听证制度、防止减刑冲击与修改假释实体条件等方面来完善现有的假释制度。     

关于我国减刑制度的几点思考

减刑是我国一项重要的刑罚制度,在矫正犯罪和鼓励犯罪人自新方面发挥着不可替代的作用。然而,我国现有的减刑制度远未成熟,特别是对减刑的法律性质、减刑权行使的主体等方面还有不同的认识,在司法实践中也存在不少亟待统一的问题,这些问题的存在影响了减刑制度作用的发挥,因此,有必要对这些问题予以厘清。     

论减刑制度对调节刑罚过剩的作用

减刑制度是刑法的重要组成部分,是刑罚执行工作的重要环节。减刑从性质上理解是对原判刑罚的变更,在适用上必须严格符合对象条件、实质条件以及限度条件。文章通过梳理减刑制度的基本理论以及刑罚过剩的原因,进一步分析减刑制度对调节刑罚过剩的作用,揭示刑罚过剩存在的合理性,明确只有将减刑和刑罚过剩在法律的范围内有机地进行结合,才能更好的发挥两者的作用。     

浅谈如何完善减刑、假释监督程序

减刑和假释都是在刑罚执行过程中对特定服刑人员采取的变更执行措施。减刑是指对判处管制、拘役、有期徒刑和无期徒刑的罪犯,在执行期间确有悔改或者立功表现的,依法减轻其原判刑罚的一种制度。我国的减刑制度主要体现在《刑法》第78条至80条之规定上。

有期徒刑执行中存在的问题及解决的对策

随着我国民主法制建设的不断进步以及行刑制度与国际的逐渐接轨，我国监狱在有期徒刑执行中暴露出诸多问题。只有建立和完善科学的分类分押制度，依法、严格、科学、公正的开展狱政管理，制定科学的减刑假释细则。充分保障监狱运行资金，强化行刑社会化，完善有期徒行执行的法律制度，才能使监狱有期徒刑执行又好又快向前发展。     

“赔钱减刑”的合理性分析

据报导,广东东莞法院采取“赔钱减刑”的做法,此事引发诸多争议。笔者试对这些争议意见做一些讨论,并提出设想。关于“赔钱减刑”的做法给出了简要讨论,本文认为,尽快从实体和程序上对“赔钱减刑”制度做出明确的规定,将“赔钱减刑”纳入法律规范的范畴乃是当务之急。     

浅析徇私舞弊减刑、假释、暂予监外执行罪在实践中存在的几个问题

近年来,监管场所发生的腐败案件不断增加,主要集中在为罪犯办理减刑、假释、暂予监外执行等工作环节.呈现出以下特点:一是徇私舞弊减刑、假释、暂予监外执行的犯罪活动较为活跃;二是此类犯罪活动比较隐蔽,难于发现;三是这些犯罪活动在很多情况下涉及监狱相关领导,致使查处阻力大;四是针对该罪的相关司法解释尚不完善和具体.以致徇私舞弊减刑、假释、暂予监外执行罪在实践中存在很多问题亟待解决.     

中国死刑立法的完善--以《公民权利和政治权利国际公约》为视角

《公民权利和政治权利国际公约》对死刑的适用范围、程序以及死刑犯的请求赦免权和减刑权都有明确规定，而中国有关死刑的立法在许多具体问题的规定上与该公约存在一定的冲突，适用死刑的范围不仅过于宽泛且标准不明，适用死刑的程序也并非严格，缺乏死刑犯的赦免和减刑的请求权的规定等，需要加以完善。

Some differences are due to age, gender, statue and personality. Above all, gender is one of the obvious reasons. From the discussion of the features of women＇s language, more attention should be paid to language use in social context. What＇s more, the linguistic phenomena in a speaking community can be understood more thoroughly.     

低渗透非均质砂岩油藏启动压力梯度研究

理论推导与室内实验相结合,建立了低渗透非均质砂岩油藏启动压力梯度确定方法。首先借助油藏流场与电场相似的原理,推导了非均质砂岩油藏启动压力梯度计算公式。其次基于稳定流实验方法,建立了非均质砂岩油藏启动压力梯度测试方法。结果表明:低渗透非均质砂岩油藏的启动压力梯度确定遵循两个等效原则。平面非均质油藏的启动压力梯度等于各级渗透率段的启动压力梯度关于长度的加权平均;纵向非均质油藏的启动压力梯度等于各渗透率层的启动压力梯度关于渗透率与渗流面积乘积的加权平均。研究成果可用于有效指导低渗透非均质砂岩油藏的合理井距确定,促进该类油藏的高效开发。
