自媒体环境下表达自由的规制

自媒体以其无中心化、平民化、交互性、匿名性,改变着传统媒体的环境和传播方式,掀起了媒介领域的一场革命。自媒体表达自由既使公民获得个体的自我实现,也极大拓展了公民行使政治性权利的空间。但超越边界的表达自由滋生了诸如传播色情内容、扰乱社会秩序、侵犯个人隐私及知识产权等问题,因此对自媒体传播内容及表达自由的规制迫在眉睫。在规制过程中不能超过必要限度,而限度意识则意味着自媒体表达自由的规制要坚持一定的原则。     

自媒体的道德特征

自媒体的迅速发展给人们的道德世界带来了重大变化,它增强了人们道德的自主性,展示了人自身的自主性价值、自我抉择性以及独立人格的精神属性,自主性乃是自媒体时代道德的根本属性。但是,自媒体在自身发展的同时也加剧了公共性道德的危机,由于缺乏对他人和社会的关怀,自媒体加深了人性的弱点在公共话语空间中的表现。要解决公共性道德危机,当然需要他律性法律的介入,但自律性的道德依然不可缺失。     

性自主权、道德与法律干预——以“南京换偶案”为例

换偶案作为一个聚讼纷争的特殊案例,在道德、价值多元化的时代,引发了人们对换偶的权利,道德性及合法性的多向度的思考。在将换偶纳入性自主权的思考维度中,性的自治自决也必须与责任担当与人性尊严相协调;在道德、法律的聚光灯下,即使是坚守自由主义的中立原则,对换偶之类的性行为方式,也只是主张一定的道德宽容而非道德虚无。当然,法律在有限度涉入这一高度争议的性领域时,应有坚实的干预理由并保持适度的界限。     

论道德法律化的合理性及限度——以“常回家看看”入法为视角

道德和法律在调整范围和价值追求等方面有一定的重叠。在我国现阶段道德滑坡、约束能力不断弱化的背景下,提高公民道德水平,重塑社会道德体系便显得尤为迫切和重要。道德法律化作为其中一个有效途径,有其必要性和可行性。修订后的《老年人权益保障法》中"常回家看看"入法便是道德法律化的一个例证。然而无论道德或是法律的调整作用都不是万能的,道德法律化也有其局限性,"常回家看看"入法也存在一定的操作困境;需要在此基础上,界定道德法律化的合理限度,并对提高"常回家看看"法律的可操作性和执行性提出合理化的规制措施。     

试论诚实信用原则的内涵与外延

针对人们在认识和适用诚实信用原则时对该原则内涵的模糊性与外延的不确定性的不易把握状况入手,在内涵方面,提出了"法律规制善意说",即在法律规则范围内所从事的善意行为才是诚实信用原则所许可的;在外延方面,从该原则外延判断标准入手,提出了"二标准说",即主观诚信标准和客观诚信标准,从而使人们对诚实信用原则的内涵与外延有了一个新的认识。     

以法理学角度分析网络暴力

随着社会经济的迅猛发展,互联网与人们日常生活的联系越来越密切,发挥的作用越来越大,与之同时也带来一些问题,比如网络暴力。网络暴力是一种危害程度较高、影响较恶劣的暴力形式,网络暴力表现为一些网民打着言论自由的幌子,突破言论自由的边界,利用网络发表不实言论恶意攻击他人的行为。这种不实言论侵犯了他人合法权益,甚至破坏了社会的稳定。网络暴力行为已经突破了现代法治精神中的言论自由,因此我们需要对此从道德和法律的角度进行规制,尤其是以法律的手段进行规制。不仅需要现行实体法从司法执法的角度规制,更需要从法学理论层面对法的创立与实施进行指引,以此更好地保障个人、他人、社会之间利益的平衡。     

从“杨乃武与小白菜案”透视晚清法律文化

1840年的鸦片战争,叩开了大清王朝的大门。自此以后,与其说清王朝走向了衰败,不如说从更广的意义上,中国朝着法治迈进了一大步。西方的法律文化随着晚清的媒体传入中国,与自古以来根植于人们内心的法律观念激烈碰撞、相互交融,孕育出的"新生儿"随着媒体被广为人知。晚清时代的文化浸透在生活中的点点滴滴,而媒体则透过生活展现了法律文化的方方面面。

自媒体时代的到来,对于整个社会而言,不仅能够促进信息的传播,同时也能够加强人与人之间的沟通,为人们生活学习和工作带来便利。但是对于高校学生管理而言,自媒体环境,不仅带来一些积极影响,同时也带来一些消极影响。此次研究的目的是为了探究出自媒体时代高校学生管理工作开展的方式。该文在论述过程当中采用文献法,从阐述自媒体时代的特征角度着手,通过结合相应的理论知识和自身的工作经验,针对自媒体时代高校学生管理工作开展优化路径方面内容进行探究。     

主体性、多次分家与代际均衡——基于湘中云村分家实践的考察

云村在1980年代就开始实行多次分家,且分家内容没有随着时代发展发生大的变动,分家时代际间的权利义务边界模糊,分家后代际交换理性而有温情,父子两代家庭生活独立自主且又能融洽沟通,形成一种新型的代际交换规则,是当地人主体性的一种表现。它既不同于传统道德和儒家伦理规制下的"继"中有"合"的分家实践,也与分账目分责任,遵从权利义务对等和极端理性算计的分家模式不同,代际关系呈现出一种适度理性和中度均衡。在这种分家模式下,父子两代靠关系交换来维持感情与经济合作,做人讲良心,做事讲公平的主体性原则被当地人所奉行。     

Markedness and its Interpretation in Language Use

Language markedness is a common phenomenon in languages, and is reflected from hearing, vision and sense, i.e. the variation in the three aspects such as phonology, morphology and semantics. This paper focuses on the interpretation of markedness in language use following the three perspectives, i.e. pragmatic interpretation, psychological interpretation and cognitive interpretation, with an aim to define the function of markedness.     

Features of Women's language

Language is a means of verbal communication. People use language to communicate with each other. In the society, no two speakers are exactly alike in the way of speaking. Some differences are due to age, gender, statue and personality. Above all, gender is one of the obvious reasons. The writer of this paper tries to describe the features of women＇s language from these perspectives： pronunciation, intonation, diction, subjects, grammar and discourse. From the discussion of the features of women＇s language, more attention should be paid to language use in social context. What＇s more, the linguistic phenomena in a speaking community can be understood more thoroughly.     

低渗透非均质砂岩油藏启动压力梯度研究

理论推导与室内实验相结合,建立了低渗透非均质砂岩油藏启动压力梯度确定方法。首先借助油藏流场与电场相似的原理,推导了非均质砂岩油藏启动压力梯度计算公式。其次基于稳定流实验方法,建立了非均质砂岩油藏启动压力梯度测试方法。结果表明:低渗透非均质砂岩油藏的启动压力梯度确定遵循两个等效原则。平面非均质油藏的启动压力梯度等于各级渗透率段的启动压力梯度关于长度的加权平均;纵向非均质油藏的启动压力梯度等于各渗透率层的启动压力梯度关于渗透率与渗流面积乘积的加权平均。研究成果可用于有效指导低渗透非均质砂岩油藏的合理井距确定,促进该类油藏的高效开发。
