道路交通事故的三次指数平滑预测法

为准确预测道路交通事故死亡人数和有效解决道路交通安全问题,以中国2001~2012年交通事故死亡人数的统计数据为研究对象,首先,采用三次指数平滑法,建立三次指数交通事故预测模型,对道路交通事故数据进行拟合与预测分析,绘制了中国道路交通事故的未来发展趋势图;然后,通过与一次指数平滑法、二次指数平滑法进行对比分析,得出了三次指数平滑法预测精度较高,预测值与实际值相符合的结论;最后,预测出2013年和2014年的道路交通事故死亡人数.研究结果表明:三次指数平滑法预测模型适用于短期预测,对有效预测道路交通事故具有一定的参考价值和指导意义.     

道路交通事故多元线性回归模型及其检验方法

根据多元线性回归分析基本原理,以道路交通事故数据为研究基础,依据我国道路交通安全法及实施条例等相关规定,选择导致道路交通事故发生次数和死亡人数比例较多的主要因素:超速行驶、无驾驶证与无牌照和酒后驾驶机动车等三个因素,建立道路交通事故次数的多元线性回归分析数学模型;重点结合显著性检验原理,对所建立的回归分析模型是否有意义以及如何检测导致道路交通事故发生的各个因素对回归模型的显著作用给出了检验方法,为合理、科学和有效地进行道路交通事故预测提供了理论依据。     

论机动车致害责任主体的确定

机动车的广泛应用对整个社会经济生活产生了深刻的影响.但另一方面,机动车引起的道路交通事故也与日俱增,给人们的生命财产带来极大的危害.而在道路交通事故的处理过程中,核心问题应当是确认责任主体,即事故当事人各方谁应当对受害人的损害承担损害赔偿责任.<民法典>应当对机动车事故责任主体作出明确的规定.

即发侵权抑或知识产权请求权之选择——兼议我国知识产权保护立法选择

通过对"infringemen"和"tort"的区分以及对知识产权、物权、人格权请求权等绝对权请求权和侵权责任的比较分析,认为将知识产权请求权、物权请求权、人格权请求权纳入侵权法一体规定,弊大于利。我国未来民法典的立法选择上,应选择确立绝对权请求权,即将知识产权请求权、物权请求权、人格权请求权分别规定在知识产权篇(法)、物权篇、人格权篇,从而与侵权之债即损害赔偿请求权相互配合,形成对绝对权的一个完整而周延的保护体系。

道路交通事故人身损害赔偿相关问题初探

2004年5月1日开始,《中华人民共和国道路交通安全法》、《中华人民共和国道路交通安全法实施条例》、公安部《交通事故处理程序规定》均开始实施,使用了近14年的《道路交通事故处理办法》同时宣告废止,新旧法律法规的取舍,使得道路交通事故人身损害赔偿案件的法律适用发生了显著的变化。也出现了诸如交通主管部门对交通事故认定行为的性质如何、交通事故认定书能否直接作为民事和刑事案件责任承担依据、现行机动车辆第三者责任保险是否就是《道路交通安全法》所称的机动车第三者责任强制保险、在司法实践中,对于因交通事故而死亡的受害人如何进行死亡赔偿金的支付等问题。时这些问题,应给予澄清和解决。     

交通事故损害经济赔偿归责原则探析

机动车与非机动车、行人之间发生道路交通事故造成损害,经济赔偿适用何种归责原则历来存在争议。新《道路交通安全法》第76条规定,对于发生交通事故造成损害,机动车承担经济赔偿适用无过错责任原则,引起广泛的讨论。从无过错责任原则产生的背景、内涵及特征分析,在我国,机动车交通事故损害经济赔偿适用无过错责任原则有利于维护和谐统一的法律秩序,有利于与国际接轨及保障人权,有利于促进社会的和谐发展,因此,这一原则具有广泛的法理基础和重要的现实意义。     

Markedness and its Interpretation in Language Use

Language markedness is a common phenomenon in languages, and is reflected from hearing, vision and sense, i.e. the variation in the three aspects such as phonology, morphology and semantics. This paper focuses on the interpretation of markedness in language use following the three perspectives, i.e. pragmatic interpretation, psychological interpretation and cognitive interpretation, with an aim to define the function of markedness.

Language is a means of verbal communication. People use language to communicate with each other. In the society, no two speakers are exactly alike in the way of speaking. Some differences are due to age, gender, statue and personality. Above all, gender is one of the obvious reasons. The writer of this paper tries to describe the features of women＇s language from these perspectives： pronunciation, intonation, diction, subjects, grammar and discourse. From the discussion of the features of women＇s language, more attention should be paid to language use in social context. What＇s more, the linguistic phenomena in a speaking community can be understood more thoroughly.

理论推导与室内实验相结合,建立了低渗透非均质砂岩油藏启动压力梯度确定方法。首先借助油藏流场与电场相似的原理,推导了非均质砂岩油藏启动压力梯度计算公式。其次基于稳定流实验方法,建立了非均质砂岩油藏启动压力梯度测试方法。结果表明:低渗透非均质砂岩油藏的启动压力梯度确定遵循两个等效原则。平面非均质油藏的启动压力梯度等于各级渗透率段的启动压力梯度关于长度的加权平均;纵向非均质油藏的启动压力梯度等于各渗透率层的启动压力梯度关于渗透率与渗流面积乘积的加权平均。研究成果可用于有效指导低渗透非均质砂岩油藏的合理井距确定,促进该类油藏的高效开发。
