话语·话语权·司法话语权——关于一个研究的返观与前瞻

司法话语权,就是在司法过程中参与者的言说资格和行为资格。从"话语"到"话语权"研究,成果可谓丰硕。目前直接对司法话语权进行研究的论文极少,更没有发现系统研究司法话语权的专著。虽未直接提及"司法话语权",但间接涉及司法话语权的学术成果则相对丰富。司法话语权研究创新有较为广阔的空间。进行司法话语权研究,其生命力和前景是不言而喻的。     

中国司法话语权史纲要

所谓司法话语权,就是指在司法过程中参与者的言说行为资格。中国司法话语权是从中国本土司法实践的资源当中生成、积淀和演变而来的。以新中国成立为界,中国司法话语权的产生、发展经过了一个漫长曲折的历程,其间不乏先声嘹亮、可歌可泣的华章。     

论反对司法腐败

司法腐败的产生，其原因是多方面的，就我国的情况而言，主要在于司法体制上的缺陷。为了遏制司法腐败、实现司法公正，我们可从以下几个方面努力：1、改革司法体制，完善司法制度，以制度创新遏制司法腐败；2、加强司法监督，完善检察监督制度，发挥新闻舆论监督的作用；3、改进和加强司法系统的思想政治工作，提高整个司法队伍的政治觉悟和道德水平。     

论美国司法审查制度的作用及对我国的启示

美国是西方最早建立司法审查制度的国家,该制度对于维护宪法尊严,强化法院独立地位,实现美国宪法分权制衡原则,发挥了至关重要的作用。另一方面,它作为阶级统治的工具、社会矛盾复杂化的结果,还存在许多难以克服的消极作用。但美国司法审查制度中所蕴涵的有价值的观念、制度或措施是值得我们认真研究对待的,以便对我国的法治建设有所启示。     

从“执行难”中探讨目前我国的司法体制改革

长期困扰司法工作的“执行难”暴露了目前我国司法体制中的三大弊端：司法不独立；司法公正缺乏制度保障；司法职能分配不当。要想从根本上解决“执行难”，推进社会法制化，则必须针对以上三大弊端，加快加强目前我国的司法体制改革。

独立作为起源于西方的一个重要宪政原则,有其存在的合理性,它是我国一项宪法原则,适应我国追求司法公正,构建和谐社会的需要,应该推进司法改革,改革与其相适应的各项制度,保障实现司法公正,实现社会的稳定和健康发展。     

司法独立的现状及展望

现代法治的重要原则是司法独立。由于我国的国情，决定了我国司法独立的现状：司法机构独立而非司法官员独立：职能独立而非司法权的独立；相对独立而非绝对独立；司法人员素质偏低等。唯其如此，才能保证司法独立，实现法公正，建立社会主义法治国家。     

比较分析抽象行政行为的司法审查

司法审查制度是西方法治国家普遍设立的一项重要法律制度。在现代法治国家,司法审查的实质精神,是通过司法权对行政权的监督来达到保障相对方的合法权益。由于各国国情的不同,行政法的核心任务或者最终目的表现方式有一所差异。在实行分权体制的国家,＂控权＂的色彩较浓,而在实行国家权力统一行使的当今中国,更强调的是权力与权利之间的平衡。但无论哪一种方式,司法审查作为手段之一都具有一致性,那就是一种权力对另一种权力的监督。     

浅析司法伦理与司法公正

司法伦理是社会对司法工作者在法律适用过程中行为具有应然意义的规定,在法制国家实现的过程中有着重要意义.司法伦理在当代中国建设社会主义法治国家的进程中显得尤为必要,法律适用的现状呼唤着司法伦理,司法伦理是良法实现的重要环节,是社会公正的最后屏障.     

阶层流动、社会公平感与中国公民的司法信任 ——基于CGSS2017数据的实证研究

实现全面依法治国是推进国家治理体系和治理能力现代化的基本内容和重要保障，提高司法信任则是实现全面依法治国的前提和基础。本研究利用CGSS2017数据，揭示了阶层流动对我国公民司法信任的影响及其作用机制。统计结果表明：我国公民不仅有较高的司法信任水平，而且规模性地实现了上向阶层流动。下向阶层流动会显著抑制公民的司法信任，上向阶层流动则会通过提升公民的社会公平感从而间接地促进司法信任；社会公平感在公民的上向阶层流动和司法信任之间发挥完全中介效应。可见，欲进一步提升公民的司法信任，须扩大其上向阶层流动机会，缓解其社会地位焦虑，强化其社会公平感。     

Markedness and its Interpretation in Language Use

Language markedness is a common phenomenon in languages, and is reflected from hearing, vision and sense, i.e. the variation in the three aspects such as phonology, morphology and semantics. This paper focuses on the interpretation of markedness in language use following the three perspectives, i.e. pragmatic interpretation, psychological interpretation and cognitive interpretation, with an aim to define the function of markedness.     

Features of Women's language

Language is a means of verbal communication. People use language to communicate with each other. In the society, no two speakers are exactly alike in the way of speaking. Some differences are due to age, gender, statue and personality. Above all, gender is one of the obvious reasons. The writer of this paper tries to describe the features of women＇s language from these perspectives： pronunciation, intonation, diction, subjects, grammar and discourse. From the discussion of the features of women＇s language, more attention should be paid to language use in social context. What＇s more, the linguistic phenomena in a speaking community can be understood more thoroughly.

Wuthering Heights, Emily Bronte＇s only novel, was published in December of 1847 under the pseudonym Ellis Bell. The book did not gain immediate success, but it is now thought one of the finest novels in the English language. Catherine is the key character of this masterpiece, because everybody and everything center on her though she had a short life. We can understand this masterpiece better if we know Catherine well.     

Lower Paleozoic oil relationships within Williston Basin, Canada

The Williston Basin is a significant petroleum province, containing oil production zones that include the Middle Cambrian to Lower Ordovician, Upper Ordovician, Middle Devonian, Upper Devonian and Mississippian and within the Jurassic and Cretaceous. The oils of the Williston Basin exhibit a wide range of geochemical characteristics defined as "oil families", although the geochemical signature of the Cambrian Deadwood Formation and Lower Ordovician Winnipeg reservoired oils does not match any "oil family". Despite their close stratigraphic proximity, it is evident that the oils of the Lower Palaeozoic within the Williston Basin are distinct. This suggests the presence of a new "oil family" within the Williston Basin. Diagnostic geochemical signatures occur in the gasoline range chromatograms, within saturate fraction gas chromatograms and biomarker fingerprints. However, some of the established criteria and cross-plots that are currently used to segregate oils into distinct genetic families within the basin do not always meet with success, particularly when applied to the Lower Palaeozoic oils of the Deadwood and Winnipeg Formation.     

低渗透非均质砂岩油藏启动压力梯度研究

理论推导与室内实验相结合,建立了低渗透非均质砂岩油藏启动压力梯度确定方法。首先借助油藏流场与电场相似的原理,推导了非均质砂岩油藏启动压力梯度计算公式。其次基于稳定流实验方法,建立了非均质砂岩油藏启动压力梯度测试方法。结果表明:低渗透非均质砂岩油藏的启动压力梯度确定遵循两个等效原则。平面非均质油藏的启动压力梯度等于各级渗透率段的启动压力梯度关于长度的加权平均;纵向非均质油藏的启动压力梯度等于各渗透率层的启动压力梯度关于渗透率与渗流面积乘积的加权平均。研究成果可用于有效指导低渗透非均质砂岩油藏的合理井距确定,促进该类油藏的高效开发。
