行政诉讼原告法律上的利害关系之界定

我国行政诉讼法上原告资格的确定标准是法律上的利益关系,但法律及相关司法解释没有对此进行进一步的细化规定,导致这一标准过于模糊而不具操作性,致使公民的合法权益受到具体行政行为侵犯时无法通过诉讼途径得以救济。本文拟通过细化确定法律上利害关系的两大要素;权益与因果关系,以期该现实问题得以解决。

浅议建立行政诉讼调解制度的构想

《中华人民共和国行政诉讼法》第50条明确规定:"人民法院审理行政案件,不适用调解。"基于这一法律规定,人民法院审理行政争议案件除了行政赔偿诉讼案件可以适用调解外,其他行政诉讼案件不适用调解。但在司法实践中并非如此,很多法院在审理行政诉讼案件时,都采取调解的手段促成原告撤诉或被告改变具体行政行为,有效降低了行政案件的信访投诉率,维护了社会稳定、和谐。但是由于调解制度在立法上的缺陷,不可避免地出现有违行政审判立法精神等问题,本文主要通过对诉讼调解理论的分析,提出我国行政诉讼中引入调解制度的构想。     

论刑讯逼供的成因及防范

刑讯逼供是封建纠问式诉讼制度的产物,是一种严重侵犯人权、破坏程序正义的非法取证方式。这种古老而野蛮的诉讼手段在现代法治社会的大背景下却屡禁不止,这一现象引起世界各国司法界的高度重视。在提倡依法治国的现代中国,尽管在法律中已明令禁止刑讯逼供,但由于传统司法观念及现行法律制度某些方面的缺位,刑讯逼供现象在我国刑事司法实践中频频出现,极大地损害了民众对司法的信心,并对社会主义法制建设事业造成了极大地损害,这就使得从理论上探讨刑讯逼供的成因及应对策略在中国显得尤为迫切。

法律规定的＂环境权＂能否进入司法,通过司法获得法律的保护,以及在多大程度上能够通过司法影响公民的环境权以及保护环境,是一个很重要的问题,对于环境权的实现,也是一个很关键的问题。构建环境公益诉讼制度成为法学界的共识,环境权的确立依据不足使环境公益诉讼缺乏坚实的实体法基础,司法实践中对原告资格的限制性解释导致环境公益诉讼难以启动。

对涉外民商事案件进行集中管辖,是我国司法改革又一重要举措。但最高人民法院《关于涉外民商事案件诉讼管辖若干问题的规定》存在三方面问题:将造成基层法院处理涉外案件法官断层的严重后果;具体内容含混、矛盾,与相关规定冲突;有以下犯上、篡越法律的嫌疑。     

论政府信息公开滥用和滥诉的规制

信息公开的滥用和滥诉既有政府信息公开条例本身不完善的原因,也是由于现阶段行政机关和法院不能很好地根据已有法律规定限制此种行为。行政诉讼法中对原告诉讼条件的限制,信息公开条例中关于申请人利害关系的规定在实践中都没有被很好地执行。立案登记制度的设立并非否定对诉讼条件的审查,行政机关和法院可以依据既有的规定对滥用和滥诉行为进行规制。     

社会募捐善款余额的归属问题探析

我国目前立法对社会募捐并没有明确的法律规定。司法实践中经常遇到募捐目的因已成就或不可能完成而消除,善款余额权属无法确定的法律问题,导致了对捐款余额所有权归属纠纷的频繁发生,因此,司法实践的要求凸显了对社会募捐善款余额的归属问题进行探讨的必要性。

目前,我国行政诉讼法并没有规定,当公共利益受到行政行为侵害时,公民可以寻求救济的途径,这是我国行政诉讼法在立法阶段应当解决的一个重要方面。反观,其他世界大国在现阶段都已经建立了或简或繁的行政公益诉讼体系,也说明了我国建立该制度的必要性。本文主要围绕行政公益诉讼在我国建立的主因和条件,探讨目前仍存在的问题并且提出相应的意见。     

Markedness and its Interpretation in Language Use

Language markedness is a common phenomenon in languages, and is reflected from hearing, vision and sense, i.e. the variation in the three aspects such as phonology, morphology and semantics. This paper focuses on the interpretation of markedness in language use following the three perspectives, i.e. pragmatic interpretation, psychological interpretation and cognitive interpretation, with an aim to define the function of markedness.     

Features of Women's language

Language is a means of verbal communication. People use language to communicate with each other. In the society, no two speakers are exactly alike in the way of speaking. Some differences are due to age, gender, statue and personality. Above all, gender is one of the obvious reasons. The writer of this paper tries to describe the features of women＇s language from these perspectives： pronunciation, intonation, diction, subjects, grammar and discourse. From the discussion of the features of women＇s language, more attention should be paid to language use in social context. What＇s more, the linguistic phenomena in a speaking community can be understood more thoroughly.     

低渗透非均质砂岩油藏启动压力梯度研究

理论推导与室内实验相结合,建立了低渗透非均质砂岩油藏启动压力梯度确定方法。首先借助油藏流场与电场相似的原理,推导了非均质砂岩油藏启动压力梯度计算公式。其次基于稳定流实验方法,建立了非均质砂岩油藏启动压力梯度测试方法。结果表明:低渗透非均质砂岩油藏的启动压力梯度确定遵循两个等效原则。平面非均质油藏的启动压力梯度等于各级渗透率段的启动压力梯度关于长度的加权平均;纵向非均质油藏的启动压力梯度等于各渗透率层的启动压力梯度关于渗透率与渗流面积乘积的加权平均。研究成果可用于有效指导低渗透非均质砂岩油藏的合理井距确定,促进该类油藏的高效开发。
