浅论个案监督存在的问题

个案监督是人大监督司法权的重要措施之一。实施以来,取得了预防司法腐败促进司法公正,提升人大权威和促进依宪治国的较好效果。但是个案监督在实践还存在诸如受案标准不统一、异化为个人监督、逾越宪政分际等问题。     

论反对司法腐败

司法腐败的产生，其原因是多方面的，就我国的情况而言，主要在于司法体制上的缺陷。为了遏制司法腐败、实现司法公正，我们可从以下几个方面努力：1、改革司法体制，完善司法制度，以制度创新遏制司法腐败；2、加强司法监督，完善检察监督制度，发挥新闻舆论监督的作用；3、改进和加强司法系统的思想政治工作，提高整个司法队伍的政治觉悟和道德水平。     

宪政视野下中国司法腐败问题探析

在特定的时空关系中，司法腐败受到司法体制不当的影响即司法权的异化的影响，所以司法腐败不仅仅是司法机关、司法人员出于故意，违反法律、法规、司法职业纪律、司法道德，损害司法关系或者司法权的行为。现今中国的司法腐败一定意义上是一个宪政问题。遏制司法腐败不但应理顺司法体制，而且要提高立法质量。     

浅议人大对法院的个案监督

近年来,司法不公成了一个热门话题,监督是各级人大的一项重要工作,个案监督则是多年来地方人大及其常委会在实践中探索、创造的一种监督形式,司法机关由于各种原因,特别是法院会办错案造成个案的不公正、不正义。人大的法定职权决定了它与社会生活在细节问题上的相对超脱,因而与那些阻力重重的个案往往没有利害关系。这使人大获得了对个案进行监督的道义上的特殊优势,从而实现案件结果的“真实”、“公平”、“正义”。     

人大司法监督的实践与创新

近年来，各地人大依法履行法定职责，对司法监督工作做了大量探索，取得新的成效，同时也存在一些问题。及时总结人大司法监督工作的新经验，客观分析人大司法监督工作存在的问题，进而提出加强和改进人大司法监督工作的新思路，对践行执政为民的理念，加强社会主义民主法治建设具有重要意义。做好人大司法监督工作，要着力改进对司法专项工作的监督，加强对司法类案、具体案件、司法人员和司法文件的监督。     

司法腐败的道德审视

司法腐败是指司法工作人员在司法过程中利用手中掌握的司法职权,违反法律规范和职业道德规范,以非正当手段谋取个人或小团体利益的行为。司法腐败是司法权的错位现象,其本质特征是权力对法律的凌辱。司法腐败的道德成因：我国传统伦理道德的影响,司法职业道德环境不良及某些司法主体道德素质低下。司法腐败的道德治理：宏观上,合理可行的司法制度建设;中观上,要制定和执行合理的司法伦理道德规范;微观上,要加强对司法主体的道德培育。     

惩治和预防司法腐败的思考

司法腐败,是指司法工作人员利用法律赋予的司法权力,在履行司法职权的过程中违反法律,执法犯法的行为。它不仅破坏了法律秩序,而且动摇了公众对司法的信任。切实有效地惩治和预防司法腐败,对于提高司法的社会公信力,建设公正、高效、权威的社会主义司法制度,维护社会公平正义具有现实意义。

就人大个案监督存在的现实性、合宪性、合理性以及必要性等诸多问题,从法学的角度作出探讨,来论证人大个案监督存在的重要性。     

司法公正的实现途径探讨

司法公正是法律价值的评价标准,司法公正包括实体公正和程序公正两个方面。实体公正是公正的本源,程序公正是实现实体公正的手段。实体公正具有相对性,程序公正是看得见的公正。实体公正优先论和程序公正决定论皆不可取,在程序公正和实体公正发生冲突时应该坚持程序优先。实现司法公正需做到以下几点：合理配置司法资源,建立能够独立行使司法权的司法体系;建立健全司法监督体系;建立完善的惩治司法腐败的制度。     

试析取保候审的适用

取保候审在司法实践中,由于客观上立法的不完善和公安机关办案人员主观错误等,使得取保候审在适用上严重违背了法律规定,滋生了司法不公和司法腐败现象,影响了诉讼活动的正常进行,有必要借鉴外国的保释制度对取保候审进行改革.     

Markedness and its Interpretation in Language Use

Language markedness is a common phenomenon in languages, and is reflected from hearing, vision and sense, i.e. the variation in the three aspects such as phonology, morphology and semantics. This paper focuses on the interpretation of markedness in language use following the three perspectives, i.e. pragmatic interpretation, psychological interpretation and cognitive interpretation, with an aim to define the function of markedness.     

Features of Women's language

Language is a means of verbal communication. People use language to communicate with each other. In the society, no two speakers are exactly alike in the way of speaking. Some differences are due to age, gender, statue and personality. Above all, gender is one of the obvious reasons. The writer of this paper tries to describe the features of women＇s language from these perspectives： pronunciation, intonation, diction, subjects, grammar and discourse. From the discussion of the features of women＇s language, more attention should be paid to language use in social context. What＇s more, the linguistic phenomena in a speaking community can be understood more thoroughly.     

低渗透非均质砂岩油藏启动压力梯度研究

理论推导与室内实验相结合,建立了低渗透非均质砂岩油藏启动压力梯度确定方法。首先借助油藏流场与电场相似的原理,推导了非均质砂岩油藏启动压力梯度计算公式。其次基于稳定流实验方法,建立了非均质砂岩油藏启动压力梯度测试方法。结果表明:低渗透非均质砂岩油藏的启动压力梯度确定遵循两个等效原则。平面非均质油藏的启动压力梯度等于各级渗透率段的启动压力梯度关于长度的加权平均;纵向非均质油藏的启动压力梯度等于各渗透率层的启动压力梯度关于渗透率与渗流面积乘积的加权平均。研究成果可用于有效指导低渗透非均质砂岩油藏的合理井距确定,促进该类油藏的高效开发。
