自由贸易协定知识产权谈判研究

我国自由贸易协定的谈判,正逐步实现和平崛起与均势维持、顶层设计与系统工程、区域整合与全球一体的"三个结合"。自由贸易协定中的知识产权谈判,也应实现"三个转变",即从脱离国内治理的国际谈判转变为以国内治理带动国际谈判、从政府的"独角戏"转变为各方参与的"交响乐"、从单一领域法律条款转变为体系化谈判条款。知识产权谈判应秉持我国国家利益,形成国家、行业协会、企业、专家学者四位一体的提出建议、征求意见、多方讨论、形成共识的谈判咨询机制,借鉴吸收发达国家的知识产权谈判经验,在学习中取胜,在模仿中超越。

Research on Negotiation of Intellectual Property Chapter in Free Trade Agreement

China''s free trade agreement negotiations, is gradually achieving the peaceful rise and balance of power to maintain the top design and systems engineering, regional integration and global integration of the "three combinations." In the free trade agreement, the intellectual property right negotiation should also realize the "three transformations", that is, from the international negotiations of domestic governance to international negotiations, from the government''s "one-man show" to all parties involved in the "symphony", from a single area of legal provisions of the system into the terms of the negotiations. The negotiation of intellectual property rights should uphold the national interests of China and form a four-in-one proposal of the state, industry associations, enterprises, experts and scholars to solicit opinions, discuss and form a consensus negotiation and consultation mechanism, draw lessons from the intellectual property negotiation experience of developed countries.
