| 摘 要： | 跨国公司滥用知识产权的现象越来越严重,极大地损害了发展中国家的利益。要规制这种滥用行为,必须明确知识产权滥用的概念。目前国内外法律中没有界定此概念,国内学者的界定不足于涵盖知识产权滥用的根本问题。知识产权滥用是指行为人违背知识产权制度目的,修改知识产权制度扩张知识产权、不当行使权利侵害他人、社会或国家利益的行为。
