| 摘 要： | 职务发明创造作为专利制度中的核心内容已经成为影响科技创新的重要载体,尽管经过多年的努力,我国科技创新体系已经发生的重大的变化,职务发明的团队创新始终是科技创新的主要方式。通过对我国职务发明专利的统计分析,并结合知识生产中研发要素及模型的讨论,总结了当前我国职务发明专利创造中的实际运行情况,提出了解决和改进职务发明创造模式的新结论。

| Abstract: | As the core of the patent system,employee's invention plays the important role in improving technology innovation.The Chinese's technology mechanism experienced tremendous transformation in past decades.At the same time,the team innovation continuously carries out main task during the employee's invention process.Through analyzing the employee's patent application statistic data,the paper summarizes operation and function of the patents 'creation made by employees in our country.At the last,paper draws a fresh conclusion on how to solve the limitation and to improve employee's invention by new structure. |
