论网络虚拟财产的民法保护

随着网络游戏业的迅猛发展,虚拟财产也逐渐走入人们的视线,它不再孤立地存在于网络游戏的虚拟空间,而是与现实社会发生了具有法律意义的联系。然而,我国在虚拟财产保护方面的法律空白使得许多关于虚拟财产的权利主张都陷入了一种无法可依的境地。因此,我国应尽快出台相关的法律,对网络虚拟财产的定义、内容及法律适用等进行具体规范,使司法机关在受理相关案件时可以对受害人进行及时有效的保护。只有加深对网络虚拟财产本身的了解和探究,加快立法步伐,在立法和司法方面得到认识上的统一,才能全面、有效地调整网络虚拟财产这一特殊的法律关系,使网络游戏产业在社会主义法治的轨道上实现平稳、健康、有序的发展。

Discussion on the Fictitious Property of Network and the Related Civil Law Protection

With the rapid development of the network game industry,the fictitious property has also come into people＇s sight gradually.It has already connected with realistic society based on law instead of isolatedly existing on network fictitious space of game.However,the legal vacancy in protection of fictitious property in our country brings a lot of rights and advocation about fictitious property into a condition of no laws to abide by.Therefore,the various circles of society require the legal protection on the fictitious property.On the basis of others＇ theoretical achievement,this article studies and explores the problems as the concept,the legal attribute and the civil law protection of the fictitious property of network.
