| 摘 要： | 离婚损害赔偿的性质是侵权责任。赔偿的义务方涉及到第三人共同侵权的，可以让第三人作为无独立请求权人参与诉讼。离婚损害赔偿应该是在财产分割以后进行。婚姻法有关财产约定制度的规定是不符合法理的。

| Abstract: | The nature of divorce damage compensation is a kind of tortuous responsibility. Concerning the third person＇s infi＇ingement upon a side marriage party＇s right together with another side marriage party, we may let the third person participate in a lawsuit as a non-independent request power side. The damage compensation should be carried out after the property division. The related property agreement legal system does not conform to the legal principle theory. |
