红三角区域政府间经济合作协议性质的法理分析

红三角区域政府间经济合作协议是红三角区域地方政府经济合作的基础，但从我国的立法上来看，该类协议的法律性质并不明确，在实践中也存在着认识上的混乱，不利于保障合作协议的顺利履行。从法理上分析，该类协议在性质上属于广义上的行政合同，政府间订立经济合作协议的行为属于抽象行政行为，协议所形成的法律关系是特殊的公务协助关系。

The Jurisprudential Analysis on the Character of Red Triangle Regional Economic Cooperation Agreement

Although the regional economic cooperation agreement is the base of the red triangle regional economic cooperation, the character of the agreement is vague in our law, and the cognition on practice is confused too. As a result, the agreement couldn' t be ensured to perform normally. To solve this problem, this article analyzes the character of the agreement by jurisprudence. It points out that the character of the agreement is a kind of generalized administrative contract; the action of the governments concluding the agreement is a kind of abstract administrative activity; the law relation of the agreement is a special kind of official assistance relation.
