论加强专利权的保护

专利法律制度在本质上是一种激励制度，是以利益来激励技术创新，从而促进社会进步。近年来我国授予专利的数量突飞猛进，随之而来的专利侵权行为也逐年增加。专利侵权行为具有多种表现形式，其形成原因也比较复杂。应该从增强权利人专利权保护的法律意识、保障专利权人的有效维权、理顺专利侵权纠纷的解决途径、完善专利权的刑法保护制度等多方面着手，严厉打击专利侵权行为，加强专利权的保护，以促进我国市场经济健康、稳定和快速的发展。

On Strengthening the Patent Protection

Patent in the legal system is essentially a kind of incentive of interest for stimulating technological innovation in order to promote the social development. In recent years, the amount of patent granted in China by the government has been increased apparently, and the patent torts increased dramatically. There are many types of patent torts in practice, and the causes of them are complicated. We should take on all kinds of strategies to crack down on patent torts and strengthen the protection of patent, such as strengthening legal awareness of people for patent protection; making the protection against patent infringement possible for ones who have the patent; straightening out the solution approach of patent infringement damages disputes; in order to improve the rules of criminal law related to the patent protection and so on. Thus, we can promote the healthy, stable and rapid development of Chinese market economy.
