网络盗版与"利益平衡"

随着网络技术的发展,“利益平衡”成为中国知识产权领域的一个新话题。作与公众之间,确有利益平衡问题。而作与盗版之间,则是侵权与维权的问题。作与公众之间,在本质上是利益一致的。网上盗版为了掩盖自己侵权的真面目,总是把自己扮做公众利益的代表,以便混淆黑白、从中渔利。打击网络侵权盗版,有利于维持作与公众利益的平衡,有利于创作的繁荣。

Really, there is a problem of a balance of interests between the author and the public. There is only the question of infringement and upholding copyrights between the author and the pirate. The author' s interest is in accordance with the public' s in essence. In order to conceal the true features of infringement, network pirates always disguise themselves as the representatives of public interest, so as to confuse black and white and to get the illegal gains. Attacking network piracies is favorable to keep the balance of interests between the author and the public and to further the prosperity of works.
