传媒对司法之谦抑态度的必要性

传媒作为一种有效的法律监督机制,对于司法公正的积极作用是不能忽视的。但传媒作为社会舆论的重要引导者,极易引发大众审判,这也给司法独立制度带来较大的威胁。传媒监督与司法独立对于法治发展进程而言都是不可或缺的,在司法充分尊重传媒监督权的基础上应如何确保司法独立?传媒在司法面前保持一种谦抑态度将更有利于二者的良性互动,"谦抑态度"强调传媒在监督的同时致力于维护司法权威,理性对待司法审判之结果,这对于法治发展是十分必要的。

The Necessity of the Self-effacing Attitude of Media about Judicial Independence

The media,as an effective legal supervision mechanism,whose active affection to the judicial justice cannot be ignored.However,as an important guide of public opinion,it is extremely easy to cause public trial,which brings great threat to the judicial independence system.The media supervision and judicial independence are both indispensable for development process of ＂rule by law＂.On the basis of that the judicature fully respects the media supervision,what should be done to ensure that the jurisdiction can be independent？ This article will try to explore the necessity of the media to maintain self-effacing attitude before the judicature for the development of ＂rule of law＂,from the view of the relationship of media and the judicature.
