| 摘 要： | 人工生育作为自然生育的补充，有利于增进人类福祉。然而，人工生育的子女法律地位如何确立，理论界和实务界均未统一。若以人工生育目的性原则、子女最佳利益原则和自己行为、自己负责原则来确立人工生育的子女的法律地位，则既符合民法的精神和原则，也有利于保护人工生育的子女之利益。

| Abstract: | Artificial birth can redeem the defects of natural birth and favors human being's interests. However, disagreements exist in theory and practice as how to settle the legal status of artificial birth. If considering the principle of artificial birth purpose, best interests for child, and being accountable for one' s actions, it can not only conform to the spirits of Civil Law, but also favor the child's interests of artificial birth. |
