| 摘 要： | "三鹿"、"伊利"等企业的"三聚氰胺奶制品"事件,在国内引起轩然大波,可以从多角度分析、反思其中所暴露出的问题。结合此事件,以我国商标法及其实施条例和有关司法解释为依据,论述、分析我国驰名商标认定法律制度,有利于发现和完善我国现行驰名商标法律制度中存在的问题——撤销制度的缺失。

| Abstract: | "melamine-milk products" event appeared in "San Lu","Yi Li" enterprises,which caused uproar in domestic,from analysis of various angles,which reflect on the problems exposed.Study on the legal system of Chinese well-known trademark,by Chinese Trademark Law and its implementing regulations and relevant judicial interpretations,pointing out one of the problems about Chinese well-known trademark legal system: revocation system missing. |
