| 摘 要： | 犯罪是由各种主客观事实情况即情节构成的,宏观上的犯罪与刑罚的关系实质上是微观上的情节与刑罚的关系。情节与刑罚有三种结构关系,起点刑情节与量刑起点是抽象个罪的基本刑关系;增加刑情节与增加刑罚量是具体个罪的单独增加刑关系;调节刑情节对基准刑的调节比是具体个罪的整体调节刑关系。情节与刑罚有二种数量关系,一种是单一数量关系,即量刑情节对应的刑罚是一个具体值而非幅度,如量刑起点;另一种是幅度数量关系,即量刑情节对应的刑罚有一个可变化的幅度,如对基准刑的调节比。

| Abstract: | Crime is being composed of a variety of the subjective and objective facts （or plots） in the case, the crime and punishment of the relationship is essentially a microcosm of the plot with punishment. There are threetypes structure relationship between plots and punishments. It is an essential term of imprisonment between the plots of the starting point of torture and starting point of the sentencing. It is the relationship in increasing penaltybetween the plots of increasing penalty and the increasing penalty. It is the adjusting relationship between the basis of adjustment and the crime. There are two types quantitative relationship between plots and punishments：the single quantitative relationship and the range quantitative relationship. |
