交通肇事罪理论价值评析--兼评《道路交通安全法》

在交通肇事罪的认定和处理中，仍坚持传统的旧过失论是不合时宜的，我们应当借鉴国外现处于主流地位的新过失论，以期正确处理交通事故；我们在交通事故的处理中不应承认所谓的共同过失犯罪、过失教唆犯以及监督过失。在人来人往的地点和时间，交通肇事后逃逸致人死亡，构成交通肇事罪与遗弃罪的想像竞合；在人迹稀少的地点和时间，交通肇事后逃逸致人死亡，构成交通肇事罪与不作为的故意杀人罪，均只需以交通肇事罪定罪处刑即可。

The Theory Value Comments of the Crime of Causing Traffic Casualties--Concurrently Comment on the Road Traffic Safe Law

In the determined and disposition of the crime of causing traffic casualties, the traditional theory of old offense is not appropriate to the occasion. We should use the theory of new offense, which is in position of main trend of other countries for reference to dispose the traffic accident correctly. We should not admit the joint offense though negligence, instigator through negligent and supervision offense in the disposition of traffic accidents. In the place and time of coming and going in great number, if a person escapes after traffic casualty and causes death, it will convict the imaginative joiner of offense of the crime of causing traffic casualties and the crime of abandonment. Under reverse situation it will convict the crime of causing trafficc casualties and the crime of intentional homicide negatively. And both of them could convict the crime of causing traffic casualties to convict and criminally punish.
