论产品责任中的纯粹经济损失

对于纯粹经济损失案件的处理究竟是适用合同法的调整还是适用侵权法的救济,各国至今没有统一的司法实践。纯粹经济损失已成为各国法官们面临的棘手问题。从法解释学的角度看,我国现有的立法资源还是为产品责任中的纯粹经济损失作了相关的规定,然而法律的模糊性要么让法官陷入有心无力的境地,要么造就法官滥用自由裁量权。因此有必要构建我国产品责任中的纯粹经济损失保护制度以便解决司法实务面临的尴尬。

Pure Economic Loss in Product Liability

For the handling of cases of pure economic loss whether it is applicable to the adjustment of contract law or the application of tort relief,countries have no uniform judicial practice.Pure economic loss has become problems to the judges.from the hermeneutical viewpoint of law,China＇s existing product liability legislation resources as regards to regulating pure economic loss in the relevant provisions had been made;however,the ambiguity of the law either lets the judges into a powerless position or brings up the abuse of discretionary power of judges.Therefore,it is important to construct the pure economic loss in product liability protection system to solve the embarrassment faced by judicial practice.
