论金融衍生工具跨国交易风险的国际法监管

金融衍生工具跨国交易不仅风险大,而且具有难以监管的特点,因国内法监管风险的局限性,有关国家若单纯从国内法的角度去监管金融衍生跨国交易风险,则很难达到风险监管的预期效果,因而需要有关国家的合作,通过制定国际条约的形式对金融衍生工具跨国交易风险进行强而有力的国际法监管才能达到及时防范化解国际金融风险的目标,而要达到这一目标,必须要从国际法层面完善目前有关金融衍生工具跨国交易风险的监管措施.

On Supervision of Risks in Transnational Transaction of Derivatives in International Laws

The transnational transaction of derivatives is not only risky but also difficult to supervise. Due to the limitation of domestic laws in supervising risks, if the countries concerned only supervise the risks in transnational transaction of derivatives in the aspect of domestic laws, they can hardly achieve the expected effects, so it is necessary to cooperate with each other to carry out powerful supervision of transnational transaction of derivatives in international laws in the form of international treaty, so as to achieve the aims of avoiding and resolving transnational financial risks in time. Hence, we need to improve the supervision measures concerning risks in transnational transaction of derivatives in the aspect of international laws.
