影响高校学生管理法制完善的若干因素分析

高校学生管理法制化是实施依法治国的重要环节。笔者认为,传统观念中的人治观念、义务本位观念、息诉观念、教育观念等影响着学生管理法制的完善;高校与学生的法律地位不明确,导致学生管理的规章制度中学生的权利、义务界定不清;高校自主权作为一种权力在行使的过程中,法律责任不明、缺乏必要的监督;高校在教育市场上的强势地位,使得学生管理的法律、法规没有得到很好的贯彻和执行。

Factors on the Perfection of Legal Management of University Students

The legalization of management of university students is an essential part of implementing the policy of ruling the country by the law.It is pointed out that the traditional concept of management,that is, to manage the students administratively;to emphasize the obligations of students;to tolerate and obey the law,and the concept of educating students,etc.affect the perfection of the management system in universities.The main problems put forward are the follows: the unclear legal positions of university and students results in the vague division of students' rights and obligations in university's rules and regulations;universities' power to make their own decisions lack necessary supervision owing to the dim legal duties in their implementing process;and the favorable position the university acquires in the educational market affects the implementation of the legal rules and regulations of managing the university student.
