| 摘 要： | 文章阐述了招投标过程中存在违法规避招标、规避公开招标、通过编制招标文件事先确定中标单位、泄露评委名单、串通投标、挂靠企业资质投标、招标后随意变更合同等违规现象,分析了招投标过程中的商业贿赂出现了利用合法交易的幌子受贿、未实际出资而享有收益型受贿、期货交易型受贿、非财产性利益贿赂、利用特定关系人收受贿赂等新形式,提出应当完善招投标制度,加强对违反《中华人民共和国招标投标法》行为的惩处力度,并扩大对商业贿赂犯罪圈的认定范围。

| Abstract: | There is the phenomenon of illegal in bidding process such as illegal circumvent bidding, evasion ofpublic bidding, determining a successful unit as bid winner in advance through the preparation of tender docu-ments, leaking name list of judges, collusive bidding, affiliated enterprise qualification tender, and arbitrarilychanging the content of contracts after bidding. Commercial bribery in bidding process appears new forms suchas accepting bribes through the guise of legal transaction, enjoying benefits without investment, futures transac-tion bribery, non property interest bribery, and taking bribes by a person of specific relationship. So we shouldimprove the bidding system, strengthen the punishment for violation of ＂Bidding Law＂ behavior and expand thescope of commercial bribery crimes. |
