| 摘 要： | 专利申请权能否质押,各国的立法态度并不相同,学术界对此也有争论。我国立法中并没有明确规定专利申请权可以质押。专利申请权是符合权利质权的适格条件的,应允许其作为质押标的。但必须明确专利申请权质押的法律地位,并完善专利申请权质押的相关配套措施。

| Abstract: | Attitude of national legislation is not the same towards whether the patent application right can be pledged or not.Our legislation is not clear that the patent application rights can be pledged.The patent application right is the eligible conditions in the right of the pledge.The subject should be allowed as a pledge.But we have to be sure of the legal status of the patent application right pledge and improve the related measures of the patent application right pledge. |
