| 摘 要： | 在行为人冒充国家机关工作人员的身份或职称去骗取财物的情况下,刑法理论和司法实践却存在着很大的分歧,笔者认为要彻底解决这些矛盾,可以考虑对诈骗罪、招摇撞骗罪和冒充军人招摇撞骗罪在立法上进行重构。

| Abstract: | There exists a great difference between the theory of penal code and juricial practice on the occasion which the persons defraud others of money and property.In order to solve the problem,the author think that it is necessary to practise the reconstitution of crime of swindling and bluffing,crime of fraud and crime of swindling and bluffing posing as a soldier in the legislation. |
