网络舆论干预司法公正的现象和危害

在司法实践中,由于判决不公、报道不当等原因,出现了网络舆论干预司法判决的现象,甚至＂媒体审判＂,具体案例有云南李昌奎案及赛锐27刀捅死女孩案、药家鑫案及药父诉张显侵犯名誉权案、彭宇案翻案及小悦悦案等。这对我国法制社会建设进程是很不利的,会产生超越监督界限、增大法官压力,引起舆论争议、浪费优质资源,损害司法权威、降低司法公信力等危害。网络干预的始作俑者是司法不够公正,并且网络的力量确实帮助部分受害者获得了公平,但这并不能说明网络干预就是完全正义的。司法判决的唯一依据是且只能是法律和事实,要减少网络舆论对司法判决的干预必须从源头做起,需要每个司法工作者都做到严格执法、秉公执法。

Phenomenon and Harm of the Internet Public Opinion Interfering with Judicature Justice

In the judicial practice,because of the unjust judgment and inappropriate report,the network public opinion is interfering the judicature justice,even the ＂trial by media＂,such as the case of Li Changkui,Sai Rui,Yao Jiaxin,Yueyue,and the reversing of Peng Yu＇s case.This is very bad to the construction of the legal system society.It will overpass the line of supervision,increase the pressure of the judge,stimulate the public opinion argue,waste the high quality resources damage the authority of the judicature,and reduce the credibility of the judicature.The legal unjust cause the network public opinion interfering,and the power of the Internet help some victims to get the just in deed,but it doesn＇t means that the Internet interfering is totally justifiable.The only basis of the judgment is the law and fact,if we want to reduce the Internet public opinion interfering,we must find out the source,keep every one judge impartial.
