| 摘 要： | 《刑法修正案（八）》增设了拒不支付劳动报酬罪,使欠薪的入罪讨论暂告一段落,当前探讨的主要问题转为该罪的司法适用问题。从基本范围上看,＂劳动报酬＂只包括基于劳动关系产生的报酬,而不能包含基于劳务关系产生的报酬。＂劳动报酬＂包括工资,但也不仅仅限于工资范畴。社保个人缴费及经济补偿金也应属于该罪名的保护范畴,但惩罚性款项不属于该罪名的保护范围。

That m ade the discussions w hether this act should be incrim inated com e to an end tem porarily.The m ain issue has becom e how to m ake this crim e work effectively in judicial application.The ＆quot;R em uneration＆quot; only includes the rew ard based on labor relations, not the rew ard based on service relations.＆quot;R em uneration＆quot; includes w age, but not lim ited to it The individual paym ent of social security and the econom ic com pensation also belong to the scope of protection,w hile the punitive m oney does not. |
