WTO农业补贴协议下中国农民发展权的实现

发展权是一项主要针对社会弱势群体的综合性人权。在我国，农民是一个弱势群体，实现农民的发展权是解决“三农”问题的关键。然而，由于农业的天然弱质性，农民发展权的实现需要政府对农业给予足够的补贴。WTO（农业协议》对农业补贴的规定体现了对发展权的关注。我国的农业补贴制度应在遵循WT0的相关规则及我国的人世承诺的基础上，以实现农民发展权为目标，调整补贴结构，完善补贴法律制度，推进农民组织化建设。

Accomplishment of the Farmers＇ Development Rights Under the Subsidy Provisions of WTO

Right of development is a comprehensive human right that is mainly applicable to the social weak group. In China farmers are a group of the weak, so accomplishing farmers＇ right for development is the key problem for ＂three agricultures＂ . However, thanks to the born weak equality of agriculture, the accomplishment of farmers＇ fight for development needs enough subsidies from government. The provisions about subsidy in the Agricultural Agreement under WTO pay much attention to the right. The laws on subsidy in China should agree with the provisions under WTO and the promise made by our government to achieve the goal of the accomplishment of the farmers＇ fight for development. Besides, we should adjust our subsidy structure, improve our subsidy legal systems according to the provisions of WTO and push farmers organizational establishment.
