物业管理制度比较研究

随着我国房地产业的迅速发展，物业管理纠纷案件逐年增多，而解决物业管理纠纷的法律规范原则性规定较多，制度规定不够详尽或明确，给正确处理该类纠纷带来一定难度。美国的物业管理行业经过100多年的发展，行业内的制度规范和运作比较成熟，通过对中美两国物业管理制度的对比分析，总结出对我国物业管理纠纷解决能有借鉴作用的相关规制。

A Comparative Study of Real Estate Management Systems

The rapid development of Chinese real estate industry has led to a dramatic increase in real estate management disputes. However, the relevant Chinese laws on the resolution of these disputes are too broad in principle, lacking substantive and concrete details necessary for the just resolution of these disputes. Developed over 100 years, U.S. real-estate management system is one of the most mature and sophisticated in the world. Through a comparison of Chinese and American real estate management systems, this paper draws several important implications on possible changes in Chinese laws that could lead to better resolution of real estate management disputes.
