| 摘 要： | 动产抵押是曾一度存在于古罗马法中的重要担保制度,动产抵押应采用登记要件主义为宜,动产抵押应当采用和不动产抵押不同的公示方式,并应规定动产抵押权不同于不动产抵押权实现的方式。我国应参照他国的立法经验,在未来的《物权法》中规定动产抵押制度。
