| 摘 要： | 在梳理清末民初地方法治研究现状基础上,以清末民初云南的地方法治及其实际运作为个案,结合新史学并采用多学科分析方法进行区域深入考证,对这个历史时期的云南地方与中央关系作了实证研究。运用国家与社会这一理论框架,通过清末民初云南地方的法治关系、权力体系、法律控制和法治文化客观描述和分析,集中剖析云南地方精英政治与平民政治的互动关系,从法律社会学和历史人类学的视角,以清末民初中央地方关系史研究中方法论转型为侧重点,来揭示近代化转型期云南地方法治发展的过程。
