| 摘 要： | 纵观我国依法治国的历史和现状，特别是1949年以后我国法制建设经历的三个阶段可以形象地比喻为“刀把子”时代→“指挥棒”时代→“马笼头”时代。“刀把子”是阶级斗争年代法律作用的主要标志；“指挥棒”是指把法律作为行政管理的工具；“马笼头”是宪政法治时代法律功能的标志。如今我国的法制建设，离市场经济对法制的要求尚有不小的差距，需要法律来约束和规范国家的权力，这既是市场经济的需要，也是我国依法治国的必由之路。

| Abstract: | Historically, especially from 1949,the government of our country experienced three stages which we can term them as knife stage,commanding stage and horse halter stage.They are characterized respectively by class struggle,law and constitutional law function.The present legal system is far from the perfection demanded by the market economy. |
