| 摘 要： | 通过相关案例,阐释了离婚精神损害赔偿的基本理论,并对中国的离婚精神损害赔偿的适用范围和主体进行了实证分析。认为修订后的《婚姻法》及相关司法解释确立了离婚精神损害赔偿制度,这无疑是中国婚姻家庭立法的一个重大进步。

| Abstract: | This paper interprets the basic theories of compensation for mental injuries in divorce with some cases as examples, and makes an empirical analysis of the application scope and subjects of such compensation. It holds that the amended Marriage Law and relevant judicial interpretations have established the system of compensation for mental injuries in divorce, which is surely a significant progress of China in making family and marriage laws. |
