| 摘 要： | 相对于日益增加的医疗纠纷,当前的医疗纠纷的解决机制明显滞后,这在很大程度上是因为医疗纠纷相关法律的认识上仍然存在误区.在讨论医疗纠纷的种种表象的同时,必须对医疗法律关系中如:医疗者的义务、医患关系、医疗合同等基本概念进行剖析,重新认识 ,这才是解决各种医疗纠纷的法律问题的关键.

| Abstract: | Corresponding to increasing medical disputes,the present settlement mechanism to the medical disputes lags apparently behind,which to large extent is owing to the mistaken idea still existent on the recognition to the relative laws about medical disputes.When discussing the various phenomenon of medical disputes,the basic concepts in medical law relationship must be analyzed and recognized,such as obligation of medical staff,the relationship between doctors and patients and medical contracts,which are the key to settle the law problems in all medical disputes. |
