论我国离婚的法定条件

我国现行婚姻法规定离婚的方式有两种,即行政程序离婚和诉讼程序离婚。行政程序离婚的法定条件是夫妻双方自愿离婚,且对子女和财产问题已有适当处理,实际上采用的是婚姻关系破裂标准。诉讼程序离婚的法定条件是夫妻感情确已破裂,调解无效。但婚姻关系是否破裂、破裂程度的标准难以把握。同时,以夫妻感情破裂作为准予离婚的标准不十分符合我国当前婚姻状况实际,有悖婚姻自由原则。从婚姻的本质、马克思主义婚姻观、我国离婚制度的历史沿革、人们婚姻家庭观念的变化和离婚司法实践来看,以婚姻关系破裂作为诉讼离婚的法定条件更为适当、科学。

Legal Terms of Divorce in China

In our present Marriage Law,there are two ways to obtain divorce,namely,by administrative procedures or by proceedings.Legal terms for administrative procedures are that the couples involved are willing to divorce,and have properly settled the matters of child bringing-up and property division.It's in nature by the standard of marriage breach.Legal terms for proceedings are that the couples' marriage has really broken up and beyond intercession.However,it is hard to decide whether the marriage has broken up,and to what degrees.Meanwhile,to grant a divorce by marriage breach is not up to the present marriage conditions in China,and is against the principle of marital freedom.Judging from the essence of marriage,Marxist marriage view,the evolution of divorce,change of ideas about family and marriage, and judicatory practice of divorce,it is more appropriate and scientific to regard marriage breach as a legal term of a suit.
