| 摘 要： | 正确处理公民权利与政府权力的关系,在矛盾中探求解决机制,是构建"和谐社会"的题中之义。本文分析了私权利优位主义与公权力优位主义在"零和博弈"框架下的局限,进而指出以"正和博弈"视角研究两者的平衡、互动关系要从政府、公民以及社会组织三个方面来进行。

| Abstract: | Correctly handling the relations between the civil right and the government power and seeking for coordination mechanism in the contradictions are prominent characteristics of constructing a harmonious society.The paper analyzed the limitations of two interpretation modes:supremacy of private right and supremacy of public power under the framework of the zero-sum game,and further pointed out that probing into the interactive equilibrium relations of them from "positive-sum game" perspective should be conducted from the three prospects of government,citizens and social organizations. |
