论高校教育管理的法律控制——以高校学生管理规章为例

在权利受到认真对待的时代,高校学生合法权益屡屡受到来自高校办学自主权这一校内治权的侵害,应是当前我国高校教育管理中一个应引起高度重视的问题。本文以高校学生管理规章的制定为例,讨论了高校办学自主权的法律性质,并在此基础上,提出了通过法律实现对高校自定学生管理规章的控制的若干对策建议。

Lawful Restriction on University's Education and Management

In the period of respecting right, great importance should be attached in the university management that the college students' lawful rights and interests are usually harmed by the university decision-making right. Taking the university management principle as example, after studying the lawful character of university decision-making right, this paper proposes some measures and countermeasures to restrict the students management principle made by the universities.
