| 摘 要： | 社区矫正并非人道主义的胜利,其本质依然是循着"理性"和"人道"获得的合理性来实施对人的权力统治和奴役,是一种新的更为隐蔽的权力规训技术;社区矫正的核心和焦点是对犯罪人的行为养成和再社会化,而非企图改造犯罪人的思想;社区矫正的存在和刑罚轻缓也没有必然联系,并不意味着国家刑罚权的惩罚力度的减弱。

| Abstract: | The very reason of community corrections existence and execution is not to respect for humanity,but to facilitate a new economy and a new technology of the power to punish.The aim of the community correctional system should not to change the thoughts of the offenders,but to correct their actions to fit for the society.There is not necessarily relationship between community corrections and the venial penalty,that is to say,community correctional system does not means diminishment of national penal power. |
